Wheatland Custom Homes, Defendant COMPLAINT Common pleas No. 04-5683 1. Our house at 6007 Sommerton Drive, Mechanicsburg, PA 17 050 was built by defendant in November 1998. 2. Since November, 1998 we had to fix the roof four times: 2/1999 -fixed by defendant under warranty 11/2003 - paid by insurance company; we paid the deductible amount. 4/2004 - paid by plaintiff 9/2004 - paid by plaintiff. This time we also had leakage from the rain in master bedroom. In all cases shingles were blown off the roof. 3. We contacted the defendant several times to get his help with repairs. We also sent registered letter stating all problems we had with five years old roof. We never heard back from him. 4. All houses on our street were built around the same time andl none of them had so many problems with lost shingles. 5. We hired two different contractors to make repairs. They both gave us reports in writing that our roof was installed improperly. They also noted that there should be at least ten years warranty on roof installation. 6. We faxed both reports to the defendant and asked for his help again. We did not receive any response. 6. We now face the costly task of reinstalling roof on the six years old house. We are asking court to award the plaintiff the amount of $6,000 for the roof replacement. 7. The owner is believed to be Rick Martin, and has his principal place of business at 447 Granite Run Drive, Lancaster, PA 17601. 1 The parties entered into an Agreement of Sale dated June 27, 1998 for the erection of a home in which the Plaintiffs presently reside, which Agreement of Sale is attached hereto as Exhibit "A" and incorporated herein by reference. 4, Several months after settlement on subject premises, Plaintiffs had difficulty with the roof which was installed at subject premises. At that time, and on numerous subsequent occasions, during any windstorm, shingles blow off of the roof of the home. 6. The first time shingles were blown off the roof by wind, Defendant did in fact send contractors to attempt to fix the problem. During each subsequent occurrence, Plaintiffs would notify Defendant, who indicated that his company was unable to fix the problem. 8. Plaintiffs continued to complain and received no satisfaction from Defendant. Plaintiffs took stop gap measures to fix the roof each time shingles blew off due to wind and spent a total of $650.00 in an attempt to remedy the problems. 10. Defendant has continually refused to honor its warranty and fix the roof indicating that there is no way the roof could be fixed. 11. Plaintiffs have received numerous estimates, all of which indicate that the roof must be replaced, since it was improperly installed. 12. The problems with the roof were caused by improper installation of the shingles, failure to nail them properly and the failure of Defendant to construct the roof in a good and workmanlike manner. 13. The damages sustained by Plaintiffs are as a direct result of the breach of implied and express warranties of Defendant. 14. Plaintiffs had received an estimate from Lowe's to totally replace the roof for $9,930.00, a copy of which estimate is attached hereto and marked Exhibit "B" and incorporated herein by reference.
