S7~O CiutL ~~ vs. LINDA UTZINGER, Defendant CIVIL ACTION - LAW COMPLAINT I. BREACH OF CONTRACT 1. Plaintiff is CitiFinancial, Inc. (CitiFinancial) with a place of business at 6250 Carlisle Pike, Suite 405, Mechanicsburg, PA 17055. 2. Defendant is Linda Utzinger who resides at 141 Sharon Avenue, Mechanicsburg, PA 17055. 3. On January 29, 2003, pursuant to a disclosure statement, note and security agreement, signed and agreed to by Linda Utzinger, the location of which is unknown I CitiFinqncial loaned to Linda Utzinger the principal sum of $10/301.19. 4. The disclosure statement I note and security agreement called for Linda Utzinger to pay back to CitiFinancial the aforesaid principal sum plus 19.00% interest by way of making 90 monthly payments of $174.73 beginning on March 10, 2003. 5. Linda Utzinger has failed to make payments pursuant to the aforesaid note. 6. The balance owing on said note is $11,567.37. 7. CitiFinancial has demanded that Linda Utzinger pay the aforesaid balance I however, Linda Utzinger refuses to do the same. WHEREFORE, CitiFinancial requests judgment against Linda Utzinger in the amount of $11,567.37. II UNJUST ENRICHMENT 8. Paragraphs 1 through 7 set forth above are incorporated herein by reference. 9. If Linda Utzinger is not legally obligated to pay back to CitiFinancial the aforesaid sum, then Linda Utzinger will be unjustly enriched at the expense of CitiFinancial.
