is 3 percent[72 P.S.§9116 (a)(1.1)(i)).
For dates of death on or after Jan. 1, 1995, the lax rate imposed on the net value of transfers to or for the use of the surviving spouse is 0 percent
[72 P.S.§9116 (a)(1.1)(ii)].The statute does not exempt a transfer to a surviving spouse from tax, and the statutory requirements for disclosure of assets and
filing a tax return are still applicable even if the surviving spouse is the only beneficiary.
For dates of death on or after July 1,2000:
• The tax rate imposed on the net value of transfers from a deceased child 21 years of age or younger at death to or for the use of a natural parent, an
adoptive parent or a stepparent of the child is 0 percent[72 P.S.§9116(a)(1.2)].
• The tax rate imposed on the net value of transfers to or for the use of the decedent's lineal beneficiaries is 4.5 percent,except as noted in[72 P.S.§9116(a)(1)].
• The tax rate imposed on the net value of transfers to or for the use of the decedent's siblings is 12 percent [72 P.S.§9116(a)(1.3)]. A sibling is defined,
under Section 9102,as an individual who has at least one parent in common with the decedent,whether by blood or adoption.

Street, Carlisle, Cumberland County,Pennsylvania 17013 (herein referred to as "Obligor"), does promise
and covenant to pay to MENA RIVERA and LYDIA M.WAGGONER, as joint Obligees with right of
survivorship as to this Mortgage Note and the Mortgage referenced herein, now of 5105 Inverness Drive,
Mechanicsburg,Cumberland County, Pennsylvania 17055 (herein referred to as "Obligees"), the principal
sum of FORTY-NINE THOUSAND, NINE HUNDRED FORTY-FOUR AND 54/100 DOLLARS
($49,944.54)to be paid as follows:
The Obligor,and his executors,administrators,successors and assigns is held and firmly bound unto
Obligees,and their her executors,administrators,successors and assigns,and Obligor does hereby promise
to pay to the order of MENA RIVERA and LYDIA M.WAGGONER, the principal sum of FORTY-
NINE THOUSAND,NINE HUNDRED FORTY-FOUR AND 54/100 DOLLARS ($49,944.54); from
the date of this Note together with interest at the rate of four percent(4%)for a period of ONE HUNDRED
FORTY THREE(143)MONTHS. Said payments shall be made in lawful money of the United States of
America. Payment shall be made in equal principal installments,plus the appropriate level of interest until
the outstanding balance is paid in full.The attached Amortization Schedule will demonstrate the estimated
monthly payments and final payment assuming each payment is made timely.
Payment of the obligation evidenced by this Mortgage Note is secured by a Mortgage of even date,
granted by Obligor, as Mortgagor, to Obligees, as Mortgagees (the "Mortgage"), on certain real property
("the Collateral') situated in Cumberland County,Pennsylvania, more specifically described as follows:
ALL THAT CERTAIN house and lot of ground situate in the Second Ward of the Borough
of Carlisle,Cumberland County, Pennsylvania, bounded and described as follows:
ON the South by East Pomfret Street;on the West by lot now or formerly of A.M.E.Bethel
Church;on the North by lot now or formerly of John C.Rasp and on the East by lot now or
formerly of Saide R. Durnim.
CONTAINING 16 feet,more or less, in front on said East Pomfret Street and extending in
depth at an even width 120 feet to said lot now or formerly of John C. Rasp.
HAVING THEREON erected a two and on-half story frame dwelling house known as 137
East Pomfret Street.
THE EASTERN boundary line of the premises hereby conveyed passes through the center
of the partition wall between the house erected on the lot hereby conveyed and the house
erected on the adjoining lot on the East.
SUBJECT, NEVERTHELESS, to all valid and binding restrictions, reservations and
conditions contained in prior deeds in the chain of title to the aforementioned premises.
BEING the same premises which Mena Rivera by Deed dated June 16,2006,and recorded
in the Recorder of Deeds Office in and for cumberland County,Pennsylvania,in Deed Book
275,page 1178, granted and conveyed unto Mena Rivera and Lydia M. Waggoner,who by
subsequent deed dated the same date as this Mortgage Note and recorded in the Office of
the Recorder of Deeds for Cumberland County at Deed Book�j,Page di 3o ,granted
and conveyed to Louis Zelazny, III, the Obligee herein.
Obligees shall have,without limitation,the following rights each of which may be exercised at any
time: I)to pledge or transfer this Mortgage Note together with any of Obligees'interest in the Collateral and
any and all renewals, extensions or modifications(upon transfer of any of Obligees' interest in any of the
Collateral,Obligees shall be relieved ofall responsibility with respect thereto);2)to transfer any ofObligees'
interest in the Collateral into Obligees' names or a nominee's name; 3) to vote the Collateral after default
hereunder; 4)to notify the Obligor of the Collateral to make payment of any amount due thereon; and 5)to
receive or take control of any proceeds of the Collateral.
The occurrence of any of the following shall be a default hereunder: 1)nonpayment of the principal
sum on the Settlement Date; 2)Obligor's failure to keep any of the terms and conditions of this Mortgage
Note or the Mortgage; 2) any change in the ownership of the Collateral or a part thereof; 3) the
commencement of foreclosure or execution proceedings by the holder of any other mortgage or lien on the
Collateral; 4) the commencement of bankruptcy, receivership or insolvency proceedings by or against
Obligor; 5)the condemnation of the Collateral or any part thereof by a government, governmental agency
or authority,or a public utility;6)the death of the Undersigned Obligor or any surety,endorser or guarantor
hereof, or, 7) any Obligor's failure to pay any of its or their debts as any become due. Obligees' failure to
declare the principal sum immediately due and payable shall not prevent Obligees from doing so at a later
date for the same or a different cause.
Upon the occurrence of a default,Obligees may exercise such rights as are given by law, including
but not limited to:
I) The right to declare the principal sum due hereunder immediately payable without
notice or demand on Obligor and without requiring any recourse against any person or property liable for
or securing the obligation defined herein;
2) The immediate right of setoff against the obligation defined herein of any and all
indebtedness owed by Obligees to Obligor, whether or not due;
3) All rights and remedies available to Obligees as a secured party under the laws of
Pennsylvania or otherwise available to Obligees.
All of Obligees'rights and remedies under this Mortgage Note,the Mortgage,any other documents
now or hereafter executed,or under any laws now or hereafter enacted,shall be cumulative,and the exercise
of any of these rights or remedies shall not be deemed a waiver of any other available rights or remedies.
Obligor waives and releases his rights under any and all appraisements.
Time is of the essence.
Obligor waives presentment,demand,notice of dishonor,protest and notice of protest. The liability
of Obligor shall be unconditional and absolute without regard to the liability of any other party,and shall not
be affected by additions to, exchanges of or substitutions for the Collateral nor any indulgence granted or
consented to by Obligees, including without limitation any release of any party or Collateral,extension of
time,renewal,waiver or other modification, or the failure of Obligees to exercise any right.
All notices required hereunder shall be in writing and shall be made by personal delivery or by
certified mail,return receipt requested. Each party must accept the certified mail sent by the other. Notice
shall be addressed to the other party at the address written at the beginning of the Mortgage. Either party
may notify the other of a change of address. Any notice required hereunder shall be deemed to have been
given to Obligor or Obligees when given as provided in this section.
None of Obligor's Iiabilities hereunder or under the Mortgage shall be reduced or released by any
indulgence, or extension of time, or renewal, or waiver, or change addressed to or given to Obligor.

Obligor agrees that any issue arising hereunder shall be governed by Federal law and the law of the
Commonwealth of Pennsylvania.
Obligor irrevocably consents to the exclusive jurisdiction of the Court of Common Pleas of
Cumberland County, Pennsylvania or the United States District Court for the Middle District of
Pennsylvania, in any and all actions and proceedings, whether arising hereunder or under any other
agreement or undertaking. Obligor agrees not to object in any such action or proceeding that the venue is
improper or the forum inconvenient. Obligor agrees that service of legal process, within or without the
Commonwealth of Pennsylvania, may be by certified mail, return receipt requested.
The covenants, conditions and agreements contained in this Mortgage Note shall bind, and the
benefits conferred herein enure to,the parties hereto and their respective heirs, executors, administrators,
successors and assigns.
Obligor intends this to be a sealed instrument and to be legally bound hereby.
