AND FIRST, I direct that my funeral be conducted in a manner eori•Tponding == s
with my estate and situation in life and that all my just debts and funeral &xpenses bC-',1, w c�

fully paid and satisfied as soon as conveniently may be after my decease from the
principal of my estate, as an expense of administering my estate, including but not limited
to the meal held directly after the funeral mass.

I FURTHER DIRECT,that I shall be buried with my husband at Fort Indian
Town Gap.
c-� ALSO, I direct that all estate taxes on all assets includable in my gross estate for
the purpose of those taxes, shall similarly be paid from the principal of my estate, as an
expense of administering my estate.
AND to such Estate as it has pleased God to entrust to me, I dispose of the
same as follows,viz;
ITEM 1. I direct that all the rest,residue and remainder of my estate of which I
die seized,whether real,personal or mixed and wheresoever the same may be situate, I
give, bequeath and devise to my daughter, JOAN ANN SIMMONS, absolutely.
I have intentionally omitted my son, FRANK ROBERT RICE, from my will. It
shall be in the sole discretion of my daughter, JOAN ANN SIMMONS, to dispose of the
rest,residue and remainder of my estate as she deems fit by either sharing same with her
brother, FRANK ROBERT RICE, or not.
If my daughter,JOAN ANN SIMMONS shall predecease me,then all the rest,
residue and remainder of my estate of which I die seized, whether real, personal or mixed
and wheresoever the same may be situate, I give,bequeath and devise to my
granddaughter, NICOLE SIMMONS, absolutely.
The reasonable costs of protecting, appraising,packing, storing, shipping,
cleaning, selling, delivering, and insuring all assets disposed of in this Item 1, including
costs incurred before the issuance of letters testamentary, shall be paid as an expense of
administering my estate.
ITEM 2. Simultaneous Death. If any beneficiary dies within thirty(30)days of
my death or simultaneously with me or under circumstances where there is no sufficient
evidence of the order or our deaths other than simultaneously, I shall be presumed to have
survived that beneficiary for all purposes material to this Will.
ITEM 3. I herewith nominate, constitute and appoint my daughter,JOAN ANN
SIMMONS,Executrix of this my last Will and Testament,to act without bond.
ITEM 4. In addition to the powers vested in fiduciaries by law, my personal
representatives and their successor(s), if any, shall have the following powers, applicable
to all property held by them,both principal and income, effective without the Order of
any Court and until the actual distribution of all such property:
a) For the payment of debts or for any purpose of administration
or distribution, to sell all of my real estate, at public or private
sale, for such purpose and upon such terms as to cash and credit
as they may deem proper,without liability on the part of the
purchasers to see to the application of the purchase moneys;
b) To compromise any claim by or against my estate without the
consent of any beneficiary;
c) To make distribution hereunder in cash or in kind or partly in
cash or partly in kind at such valuations as they may fix.
ITEM 5. The interest of any beneficiary hereunder shall not be subject to
anticipation or voluntary or involuntary alienation.
