CNIL ACTION-LAW GUSTAV GILLERT, Defendant JURY TRIAL OF TWELVE DEMANDED COMPLAINT AND NOW, comes Plaintiff, ZEIGLER'S STORAGE & TRANSFER, INC., by and through its attorneys, MARTSON DEARDORFF WILLIAMS & OTTO, and hereby avers as follows: 1. Plaintiff Zeigler's Storage & Transfer, Inc. is a Pennsylvania corporation with a principal office located at 1235 Ritner Highway, Carlisle, Cumberland County, Pennsylvania. 2. Defendant Gustav Gillert is an adult individual residing at 35 Tunbridge Lane, Carlisle, Cumberland County, Pennsylvania. 3. Defendant requested Plaintiff to move Defendant's personal property from his former residence at 1647 Newville Road, Carlisle, to his current residence at 35 Tunbridge Lane, Carlisle. 4. On March 17, 2004, Plaintiff presented and Defendant acknowledged receipt of an Estimated Costs of Services (hereinafter "Estimate") showing the total estimated cost of moving as $2,318.77. A true and correct copy of the Estimate is attached as Exhibit "A." 5. The Estimate shows Plaintiff would not only move Defendant's personal property from the one residence to another but would also pack "lamps, clothes, pictures, china, crystal, figurine." Unpacking was not indicated on the Estimate nor did Defendant request Plaintiff to unpack these items. 6. Defendant requested that Plaintiff pack the itemized goods at the Newville Road residence on Friday, April 30, 2004 and then load and deliver all personal property to the Tunbridge Lane residence on May 3, 2004. 7. Because he was leaving town on April 30, 2004, Defendant rescheduled the packing of his personal property to April 27, 2004. 8. On April 27, 2004, in addition to the aforementioned services itemized in the Estimate, Defendant requested Plaintiffto pack books, kitchen items, miscellaneous items in a hall closet and to crate a valuable painting. 9. On that same day, Plaintiff presented Defendant with a Bill of Lading for $3,482.43, reflecting Defendant's recent request for additional services. A true and correct copy ofthe Bill of Lading is attached hereto as Exhibit "B." 10. As agreed, Plaintiff loaded Defendant's personal property on May 3, 2004, onto Plaintiffs moving truck. At approximately 3:00 p.m., during the unloading phase at the Tunbridge Lane residence, Defendant demanded Plaintiff stop unloading and return at another date and time. 11. With the moving truck still loaded, Plaintiff left the Tunbridge Lane residence. 12. Two days later, May 5,2004, Defendant requested Plaintiffto return to the Tunbridge Lane residence to finish unloading. 13. At that time, Defendant instructed Plaintiff to unpack all packed items, remove the wardrobes and remove all the boxes. 14. Two days later, May 7,2004, Plaintiffreturned to the Tunbridge residence to unpack Defendant's personal items. Plaintiff did not charge Defendant for this service. 15. Defendant refused to sign the Bill of Lading or pay Plaintiff for its services. COUNT I BREACH OF CONTRACT 16. Paragraphs I through 15 are incorporated herein by reference as if set forth in full below. 17. Defendant breached the express contract with Plaintiff by failing to pay the amount stated on the Bill of Lading. 18. Plaintiff complied with all terms of the Estimate and Bill of Lading. 19. The total amount which is immediately due and payable to Plaintiff by Defendant is $3,482.43. WHEREFORE, Plaintiff demands judgment against Defendant in the sum of Three Thousand Four Hundred Eighty-Two Dollars and Forty-Three Cents ($3,482.43), plus late fees, costs of suit, attorneys' fees, and interest from date of Defendant's default. COUNT II IN QUANTUM MERUIT In the alternative, if this Honorable Court determines that an express contract between Plaintiff and Defendant does not exist, which is denied, Plaintiff pleads the following: 20. Paragraphs 1 through 19 are incorporated herein by reference as if set forth in full. 21. Because Plaintiff provided services to Defendant, to the benefit of Defendant, Defendant became liable to Plaintiff for said services. 22. Defendant was unjustly enriched by accepting said services without paying Plaintiff reasonable compensation therefore. 23. The total amount by which Defendant has become enriched is Three Thousand Four Hundred Eighty-Two Dollars and Forty-Three Cents ($3,482.43). 24. Plaintiff demanded payment of the above sum and Defendant failed and refused to do so. WHEREFORE, Plaintiff demands judgment against Defendant in the sum of Three Thousand Four Hundred Eighty-Two Dollars and Forty-Three Cents ($3,482.43), plus late fees, costs of suit, attorneys' fees, and interest from date of Defendant's default.
