Whereas, Bart L. Shughart and Lisa D. Shughart, his wife, of 204 Burnt House Road, Carlisle,
Cumberland County, Pennsylvania are about to execute contemporaneously herewith, a contract with David
Dence, t/d/b/a David Dence Construction, of 32 Pennway Drive, Carlisle, Cumberland County, Pennsylvania,
for the erection of an addition and renovations to the existing dwelling house upon a lot of land situate in
Dickinson Township, Cumberland County, Pennsylvania, being known as Lot No. 14 on the Final Subdivision
Plan No. 3 for Nicholas Manor prepared by Stephen G. Fisher, R.S., dated December 8, 1986 and last revised
on September 4, 1987, as recorded in Cumberland County Plan Book 54, Page 96, being more fully described
in Deed dated August 31, 1992, as recorded in Cumberland County Deed Book "V", Volume 35, Page 1187,
and being known and numbered as 204 Burnt House Road, Carlisle, PA 17013.
Now, as of December 31,2001, at the time of and immediately before the execution of the principal
contract, and before any authority has been given by the said Owners to the said Contractor to commence work
on the said building, or purchase materials for the same in consideration of the making of the said contract with
them and the further consideration of one Dollar, to Contractor paid by Owners it is agreed that no lien shall be
filed against the building by the contractor, or any sub-contractor, nor by any of the material men or workmen
or any other person for any labor, or materials purchased, or extra labor or materials purchased for the erection
of said building, the right to file such liens being expressly waived.
