COMPLAINT
AND HEREBY comes, Cory A. Cormany, unto
and through Attorney Scherer, and establishes'
causes of action pursuant a civil remedy for the
above named Defendant, wherefore the following is
a statement set forth at length:
1. Mr. Cory A. Cormany is an adult.
individual residing in Cumberland County,
Pennsylvania.
2. C.E.O. Kenneth Levine is an adult
individual operating Levine Enterprises, alias
Kenmar Enterprises, alias Golden M Company;
within Cumberland County, Pennsylvania.
3. On or about September 5th, of the year
1997, Mr. Cory A. Cormany submitted application
pursuant The Commonwealth of Pennsylvania

appreciative; Levine Enterprises.
4. On or about April 23rd, of the year 2003,
Mr. Cory A. Cormany filed complaint pursuant The
Commonwealth of Pennsylvania preparatory;
Levine Enterprises.
5. On or about March 25th, of the year
2004, Mr. Cory A. Cormany filed complaint pursuant
The Commonwealth of Pennsylvania preparatory;
Levine Enterprises.
6. On or about September 10th, of the
year 2004, Mr. Cory A. Cormany filed complaint
pursuant' The Commonwealth of Pennsylvania
preparatory; Levine Enterprises.
7. On or about August 16th, of the year
2004, Mr. Cory A. Cormany filed complaint pursuant
The Commonwealth of Pennsylvania punctilious;
Mr. Hubert Gilroy.
8. On or about August 16th, of the year
2004, Mr. Cory A. Cormany filed complaint pursuant
The Commonwealth of Pennsylvania punctilious;
Ms. Tina Adams.
9. On or about November 22nd, of the year
2004, Mr. Cory A. Cormany delivered letter pursuant
The Commonwealth of Pennsylvania proprietorial;
The Attorney General Office.

10. Levine Enterprises did insubordinately
cause Mr. Cory A. Cormany discrimination,
prejudice, mental anguish, public humiliation,
emotional distre!?s, lost wages and employment,
benefits and expenses in the foregoing amount of
One Hundred and Twenty Five Thousand and 00
Dollars (125,000.00).
11. By reason of the aforesaid; Levine
Enterprises did deliberately discriminate with
negligence and malice, prejudicially causing mental
anguish, public humiliation slanderous distress, and
emotional deprivation of right pursuant; Mr. Cory A.
Cormany.
12. Mr. Cory A. Cormany is the said;
plaintiff and initial applicant, and hereby consents
representation and legal requisites reasonable
The Stevens Mental Health Center; respectfully
submitted exhibits A thorough F.
WHEREAS, Plaintiff; Cory A. Cormany,
claims from the Defendant; Mr. Kenneth Levine, an
amount excessive of, considerate the
commonwealth, One Hundred and Twenty Five
Thousand and 00 Dollars (125,000.00).

TO PLAINTIFF'S NOVEMBER 24. 2004 COMPLAINT
Defendant Levine Enterprises, by its attorneys, and pursuant to Penn. R. Civ. P.
1028(a)(l)-(2), (4) and 1028(f), hereby files these Preliminary Objections to Plaintiffs
November 24, 2004 complaint.
1. Plaintiff Cory A. Cormany, Defendant's ex-husband, filed a complaint against her
(captioned "Cory A. Cormany v. Tina D. Adams") on or about November 24, 2004 alleging
damages against Defendant and incorporating certain exhibits that were used in his
discrimination complaint filed against Tina Adams on April 23, 2003. Plaintiff uses the work
"discrimination" but fails to allege any facts to support such a claim, other than to say he applied
for ajob with Levine Enterprises on September 5, 1997. See Complt. '\l3.
2. The sheriff served Plaintiffs November 24,2004 complaint on June 13,2005.
3. Because Plaintiffs complaint was not served within 30 days of the date of filing
in accordance with Penn. R. Civ. P. 401(a), the prothonotary was required to "reinstate" the
complaint before service could be properly effected, Since Plaintiff did not have the complaint
reinstated, it was not valid, and therefore, service was ineffective.
4. Plaintiffs complaint suffers from an additional infirmity as well- namely, he has
failed to exhaust his administrative remedies and alleges a claim that is time-barred.
5. Plaintiffs claims against Defendant fall under the jurisdiction of either Title VII
of the Civil Rights Act of 1964, 42 D.S.C. S 2000e, et, seq, ("Title VII") or the Pennsylvania
Human Relations Act, as amended, 43 P.S. S 951, et seq. ("PHRA"). As such, Plaintiff was
required to file a charge of discrimination with either the Equal Employment Opportunity
Commission ("EEOC") or the Pennsylvania Human Relations Commission ("PHRC") within
180 days (or, in the case of the EEOC, within 300 days if proceedings were initially instituted
with a state or local agency). See 42 U.S.C. S 2000e-5(e)(1); 43 Pa. C.S. SS 959(a), 962,
6. Plaintiff neither alleged he filed a charge of discrimination nor attached
documentation demonstrating that he had done so to his complaint. As such, his complaint must
be dismissed on the merits under Penn. R. Civ. P. 1028(a)(4) because the only cognizable claim
raised therein - that he submitted an application for employment on September 5, 1997 - is
time-barred. See 42 D.S.C. S 2000e-5(e)(1); 43 Pa. C.S. SS 959(a), 962. In addition, the
complaint must be dismissed because Plaintiff failed to exhaust his administrative remedies.
7. For all of these reasons, Defendant's preliminary objections to the complaint
should be sustained.
8. The arguments and authorities supporting Defendant's Preliminary Objections to
Plaintiffs November 24, 2004 Complaint are set forth in Defendant's Memorandum of Law in
Support of Its Preliminary Objections, filed contemporaneously herewith.

WHEREFORE, for the reasons set forth herein and in Defendant's Memorandum of Law
in support of its Preliminary Objections, Defendant respectfully requests that Plaintiff s
November 24, 2004 complaint be dismissed with prejudice.
