Closing Report Regarding
The Estate of Leah Louella Hummel

Enclosed for your review are the following:
1) A copy of Leah Hummel's Last Will and Testament which is dated October 22, 2010.
2) A brief discussion of Leah's final wishes and how the estate was settled. This is the Closing
Report.
3) A copy of a spreadsheet which lists every transaction in to and out of the estate's checking
account. This constitutes the FINAL ACCOUNTING OF THE ESTATE OF LEAH LOUELLA HUMMEL.
4) A copy of the spreadsheet which shows every expense repaid to the Executor.
5) A copy of your individual RECEIPT AND RELEASE FOR FINAL DISTRIBUTION.
6) A check or checks for your inheritance from the estate.
This all is intended to serve as an informal Closing Report for the Register of Wills and other
state departments as needed.
Please deposit your check(s) and return your receipts promptly so I can get this all to the
courthouse shortly. Normally lawyers want the Receipts to be returned to them before they
actually make the payments. I'm not doing that. This is all going out at once. As soon as I get
all of the final papers to the courthouse, and close out the checking account, this estate will
have been settled.

Closing Report for the Estate of Leah Louella Hummel, PA No. 21-12-0242
As you all know,Aunt Louella died on Christmas day in 2011 while in a nursing home in Carlisle.
Her last wishes regarding her estate were expressed verbally to Hafner and me. This was after
a brief meeting at the nursing home around the end of November at which time she gave POA
to both of us. The lawyer(Hogg),who prepared the POA for that meeting, had not been
retained to prepare an updated will and left before we discussed her wishes for her estate.
Louella was in a very good frame of mind at this time and knew exactly what she wanted. She
agreed to have Hafner arrange for a lawyer to see her soon to make out a new will. He did so
and a meeting was arranged for about three weeks later.
She was quite adamant that the estate was to be shared equally by Hafner and me and that no
other relative was to receive anything. Nothing was to be left for any charity, her old church or
any other institution. She said this was because Hafner and I had spent a lot of time looking
after her and her interests for many years. (indeed Hafner had been helping her and Aunt Julia
with their affairs for the last 20-30 years.) On the other hand, except for an occasional phone
call, or a rare visit, she had not been in touch with any of the other nieces and nephews for a
long time.
Before we could have this meeting with a lawyer,Aunt Louella's health took a very bad turn for
the worse. At the time of the meeting she was unable to speak and probably could not
understand anything that was said. She could not state her wishes and consequently the
lawyer was unable to do anything. Louella never did get much better although she could
occasionally say something to the nurses.
She had previously prepared a brief handwritten will, a copy of which is enclosed. We became
aware of this will when I went through her papers to find the title for her car which we wanted
to sell. Although it was handwritten, and was not notarized or witnessed,this will met the
requirements of our state laws and was accepted for probate on February 24, 2012.
Although Hafner was listed first to be the Executor, it turned out that I would do the job. On
February 24, 20,12 1 was granted the appropriate papers to perform this duty. I discussed the
issue of verbal wills with two different lawyers and got the same answer from both of them. in
Pennsylvania,verbal wills are not acceptable except perhaps if they had been dictated to a
lawyer who was then going to have the will typed up. But that is not the case here so the
verbal will gets no consideration and the older written will must be applied.
However there is a problem with this will. The will does not adequately state what is to be
done with the estate. The will does contain specific bequests, but it does not say what is to be
done with any residual (remainder) of the estate. Once again the state laws apply. Both
lawyers advised me that the residual of the estate must be split evenly among all nieces and
nephews whether they were listed in her will or not. So that's how several of you became
heirs.
If you look at the FINAL ACCOUNTING spreadsheet you will see that I have prepared individual
checks for both the specific bequests and for the shares of the residual. The shares of the
residual are all the same at$17,342.87 except for the lucky guy that gets the extra penny.
I have one final comment regarding the residual. When Aunt Louella passed away she had no
personal property other than the few clothing items at the nursing home. About two months
earlier, when it was obvious that she would never return to her home, I began to dispose of her
items in the house (which she rented). She had nothing of value and everything was donated to
the Salvation Army or set out for the trash. This was all settled before she died.
She did still have financial assets and debts. The enclosed FINAL ACCOUNTING spreadsheet
gives details of all financial transactions. All assets were put into the Estate checking account
and all payments were made by check. So the spreadsheet list of checkbook transactions
summarizes all of the information about her estate and how things were settled.
On the other spreadsheet list I detailed every expense for which I took payment. All of these
expenses were needed and reasonable. One of these was a one time payment of$500.00 for
my time. A lawyer would charge about 10 times this amount. All other payments to me were
to repay me for actual out of pocket expenses. If there is a small final expense I'll take care of it
myself.
The last enclosure is the RECEIPT AND RELEASE FOR FINAL DISTRIBUTION. I know that everyone
signed a previous ESTATE RECEIPT AND RELEASE for an interim payment. However, I just
recently received the last one of these. Since I got it so close to the time I could make a final
settlement, I decided to go with this one-time final distribution. Please return the receipts to
me soon.
There is one more thing that Aunt Louella left for all of us. That is the Take-away lesson from
this whole experience. This story shows what happens if you do not have a will that is properly
prepared. Louella knew what she wanted at the end and was adamant in expressing it to
Hafner and me verbally. But because she did not have a proper written will, the estate not only
did not go where she wanted it to, the bulk of it went exactly where she did not want it to go.
And Hafner, who did the most over the years to help her, truly got the worst end of the deal.
This is what can happen when you don't have a proper will.
I hope this answers all questions any of you might have. I consider it an honor to have settled
this estate for Aunt Louella.

NOTE-On 6/28/2012 Executor was given an advance payment of$53.00 (check 114)for 2 future
trips to the courthouse to settle estate. One trip was made on 6/29/2012. The second will be
about the end of April 2013 to take final records to the courthouse.
NOTE-on 6/29/12 there was an expense of$15.00 for filing the inheritance tax return.
