Plaintiff MIKE DAWSON and FRANK ALBANO, III, Each Individually and Formerly Trading As ROBERTO'S Defendants CIVIL DIVISION - LAW COMPLAINT The Plaintiff, FERRARO FOODS, INC., by its attorneys, KNUPP, KODAK & IMBLUM, P.C., brings this action of Assumpsit against the Defendants to recover the sum of SEVEN THOUSAND, TWELVE DOLLARS AND TWENTY- EIGHT CENTS ($7,012.28), along with interest thereon from March 27, 2004 upon a cause of action of which the following is a statement: 1. The Plaintiff, FERRARO FOODS, INC., is a corporation organized and existing under the laws ofthe State of New Jersey, having its principal office and place of business at 287 South Randolphville Road, Piscataway, New Jersey 08854. 2. The Defendant, MIKE DAWSON, is an adult individual Formerly trading and doing business as ROBERTO'S with an address of228 Lincoln Street, Marysville, Perry County, Pennsylvania 17053. 3. The Defendant, FRANK ALBANO, III, is an adult individual Formerly trading and doing business as ROBERTO'S with an address of 36 Wetherburn Road, Enola, Cumberland County, Pennsylvania 17025. COUNT I -FERRARO FOODS. INC. vs. MIKE DAWSON and FRANK ALBANO. III Each Individuallv and Formerly Tradin2 as ROBERTO'S 4. On or about December 15,2003, Defendants did submit a Credit Application to Plaintiff and agreed to the terms and conditions of same. A true and correct copy of said Credit Application is attached hereto, marked Exhibit "A" and made a part hereof. 6. Plaintiff, at the special instance and oral request of the Defendants, sold and delivered goods, wares and merchandise to the Defendants at their place of business at 110 Old York Road, New Cumberland, Cumberland County, Pennsylvania 17070. 7. The prices charged for said goods, wares and merchandise were just and reasonable, were the legal and market prices therefor and were the prices which the Defendants orally promised and agreed to pay to Plaintiff. 8. Plaintiffs Invoices are not attached to this pleading due to the voluminous nature of same and have previously been provided to Defendants. 9. The amount due and owing by Defendants to Plaintiff is the amount of Four Thousand, Five Hundred Forty- Nine Dollars and Six Cents ($4,549.06) as shown on Plaintiffs Statement of Account hereto attached, marked Exhibit "B" and made a part hereof. 1 O. Due to the default of Defendants, and pursuant to the terms and conditions of the Credit Application executed by Defendants hereto at said Exhibit "A", attorney's fees in the total amount of Nine Hundred Nine Dollars and Eighty-One Cents ($909.81) have been added to said account. 11. Plaintiff frequently demanded payment from Defendants of said amount due and owing as aforesaid, but Defendants refused and neglected and still refuse and neglect to pay said amount of any part thereof. WHEREFORE, Plaintiff brings this suit to recover from Defendant the sum of FIVE THOUSAND, FOUR HUNDRED FIFTY -EIGHT DOLLARS AND EIGHTY -SEVEN CENTS ($5,458.87), along with interestthereon from March 27,2004. Paragraphs 4 through 11 are incorporated herein as if fully and at length set forth. 13. Plaintiff, at the special instance and oral request of the Defendants, sold and delivered goods, wares and merchandise to the Defendants at their place of business at 454 Valley Street, Marysville, Perry County, Pennsylvania 17025. 14. The prices charged for said goods, wares and merchandise were just and reasonable, were the legal and market prices therefor and were the prices which the Defendants orally promised and agreed to pay to Plaintiff. 15. Plaintiffs Invoices are not attached to this pleading due to the voluminous nature of same and have previously been provided to Defendants. 16. The amount due and owing by Defendants to Plaintiff is the amount of Two Thousand, Two Hundred Ninety-Four Dollars and Fifty-One Cents ($2,294.51) as shown on Plaintiff s Statement of Account hereto attached, marked Exhibit "C" and made a part hereof. I 7. The Defendants paid to Plaintiff on account of the aforementioned charges certain sums of money as more particularly set forth on Exhibit "D" attached hereto and made a part hereof, in the total amount of One Thousand Dollars and Zero Cents ($1,000.00). 18. Due to the default of Defendants, and pursuant to the terms and conditions of the Credit Application executed by Defendants hereto at said Exhibit "A", attorney's fees in the total amount of Two Hundred Fifty-Nine Dollars and Ninety Cents ($258.90) have been added to said account. Plaintiff frequently demanded payment from Defendants of said amount due and owing as aforesaid, but Defendants refused and neglected and still refuse and neglect to pay said amount of any part thereof. WHEREFORE, Plaintiff brings this suit to recover from Defendants: (A) Count I - The sum of FIVE THOUSAND, FOUR HUNDRED FIFTY-EIGHT DOLLARS AND EIGHTY- SEVEN CENTS ($5,458.87), along with interest thereon from March 27, 2004; and (B) Count II - The sum of ONE THOUSAND, FIVE HUNDRED FIFTY-THREE DOLLARS AND FORTY- ONE CENTS ($1,553.41), together with interest thereon from March 27, 2004; for a Judgment in favor of Plaintiff and against Defendants in the amount of SEVEN THOUSAND, TWELVE DOLLARS AND TWENTY-EIGHT CENTS ($7,012.28).
