Plaintiff is an adult individual who currently resides at 2407 lonoff Road, Harrisburg, Dauphin County, Pennsylvania 17110. 2. Defendant USA Cartage is a business entity with a professional address of 9921 Governour Lane Boulevard, Williamsport, Maryland 21795 3. Defendant Chris Hunt is an adult individual who was employed by USA Cartage on March 19, 2004 and who resides at 305 North Franklin Street, Chambersburg, Franklin County, Pennsylvania 17201. 4. On March 19, 2004, Plaintiff was traveling north on Interstate 81 near the Shippensburg Exit in Cumberland County when he pulled his automobile to the right shoulder. 5. Plaintiff's vehicle was completely on the shoulder of Interstate 81 and was in no way in the travel lane of Interstate 81. 6. On the same date, Defendant Christopher Hunt was ()perating a USA Cartage tractor trailer and was in the lawful scope of his employment. 7. Mr. Hunt operated his tractor trailer in such a fashion to sideswipe Plaintiff's vehicle thereby causing damage to Plaintiff's vehicle. 8. Plaintiff's vehicle suffered damages in the amount of $1,295,59 and Plaintiff was required to rent a vehicle while his vehicle was repaired in the amoLlnt of $316.00. COUNT I Albert Filoreto v. Chris Hunt 9. Plaintiff hereby incorporates the averments contained in paragraphs 1 through 8 above as if set forth herein at length. 10. The above-referenced collision was directly and proximately caused by the negligence of Christopher Hunt in that he: a. Failed to utilize reasonable care in the operation of this tractor trailer; b. Failed to keep his vehicle in the travel lanes of Interstate 81; c. Failed to be alert and keep a proper lookout for other vehicles on the roadway; d. Drove his vehicle inattentively without regard to the rights and safety of the Plaintiff. 11. As a direct and proximate result of Defendant Christopher Hunt's negligence, his tractor trailer struck Plaintiff's vehicle thereby causing damages to jthe vehicle in the amount of $1,295.59. 2 12. Additionally, Plaintiff was forced to rent a vehicle in the amount of $316.00. WHEREFORE, Plaintiff demands judgment against Defendants jointly and severally in the amount of $1,611.59 together with interest, delay damages, and costs of suit. COUNT II Albert Filoreto v. At the time and place aforesaid, Defendant Chris Hunt was the agent, servant, and/or employee of USA Cartage and Chris Hunt was acting within the course and scope of his agency or employment.
