Dear Judge Guido
I am writing in request for an emergency guardianship review for the guardianship of my incapacitated son, Benjamin
James Ritter, born 09113/1986, SS 188-66-8613. He is a completely incapacitated individual, having no ability of voluntary
motor sensory to move his body or to speak on his own behalf or to represent his own interest in any capacity.
An order of guardianship was entered by you on April 20, 2007, Orphan's Court Division, Cumberland County, PA, case
number 21-06-1022 at which guardianship was granted to Candi J. Yinger, biological mother of Benjamin. I am now
entering a grievance of negligence and medical neglect, and abandonment of medical responsibility of Benjamin.The
guardian, Candi, acted against the medical direction of the specialists of the Hershey Medical Center. She has taken
Benjamin to Conestoga View Nursing& Rehab, Lancaster, PA on her own actions, with the intentions of taking him to a
handi-capped apartment.The administration was mislead at Conestoga View and accepted Benjamin on the terms of Mrs.
Yinger. Conestoga View was unaware Mrs. Yinger had acted independently from the release committee plans of
placement for Benjamin, which had serious consequences for Benjamin's healthcare, because the Hershey Medical
directors would not be able to follow him as an outpatient. On this account, vital information as to the critical and special
needs of Benjamin's healthcare was incorrectly perceived by staff of Conestoga View.Therefore it was leaving the
management of Benjamin's care completely unstable throughout his stay in this facility.
Due to this circumstance Benjamin has suffered long term mismanagement of his medical care and has been a victim of
incorrect medical practices that have resulted in serious medical injury. Such plans can be confirmed by medical
professionals from Lancaster and Hershey Hospitals. Benjamin had to be hospitalized on various occasions with severe
pneumonia and pulmonary complications and is now suffering life threatening chronic health issues; including chronic
bacteria of the respiratory system, additionally since April 3, 2013 through the 8th. Benjamin was admitted to Lancaster
General Hospital and was treated for severe respiratory problems including serious infections resulting to current life
threatening conditions left undetected and unaddressed by staff and guardian at Conestoga View.
Since Benjamin's release from Lancaster Hospital, April 8, 2013, there was medical direction to be follow out by care
providers of Conestoga View. However, the guardian and staff have not followed the medical necessity of the medical
directors, putting Benjamin in further medical danger at this time. Further emergency issues to address concerning
Benjamin's medical need continue to be neglected at the facility. He is currently showing severe regression in his current
condition. The current guardian, Mrs. Yinger has refused to work on a care plan that could help stabilize Benjamin's
condition, acting against medical direction for Benjamin's now critical condition.
I now petition this plea at this time with the deepest urgency to your Honor Guido, that the court will intercede on the
behalf of Benjamin on the grounds of misrepresentation of guardianship, by abandonment and neglect and refusal to
address these emergency situations.
Thank you so very much your Honorable Judge Guido for considering my deepest pleas for my son Benjamin.
