YANCEY, is an adult individual who currently resides at 3506 N. 6 Street, Harrisburg, Dauphin County, Pennsylvania. 2. Defendant, PROGRESSIVE PREFERRED INSURANCE COMPANY [hereinafter referred to as "PROGRESSIVE'], is an Ohio Corporation with its principal place of business located at 6300 Wilson Mills Road, Mayfield Village, Cuyahoga County, Ohio. PROGRESSIVE is licensed and authorized to issue and underwrite policies to Pennsylvania motorists in accordance with the provisions of the Pennsylvania Motor Vehicle Financial Responsibility Law, 75 Pa. C.S. §1701, et. seq. PROGRESSIVE does business in Cumberland County, Pennsylvania. 3. Defendant, ERIE INSURANCE EXCHANGE, is a reciprocal insurer with its principal office located at 100 Erie Insurance Place, Erie, Erie County, Pennsylvania. ERIE is licensed and authorized to issue and underwrite policies to Pennsylvania motorists in accordance with the provisions of the Pennsylvania Motor Vehicle Financial Responsibility Law, 75 Pa. C.S. §1701, et. seq. ERIE does business in Cumberland County, Pennsylvania and maintains a NAIC number of 26271. 4. Defendant, ERIE INDEMNITY COMPANY [ERIE INSURANCE EXCHANGE and ERIE INDEMNITY COMPANY hereinafter collectively referred to as "ERIE'], is a Pennsylvania Corporation with its principle place of business located at 100 Erie Insurance Place, Erie, Erie County Pennsylvania and is the legal entity appointed by ERIE to transact business on its behalf. 5. On or about May 29, 2009, Plaintiff applied online for a motor vehicle insurance policy with . Defendant, PROGRESSIVE. 6. On or about May 29, 2009 Defendant, PROGRESSIVE, issued to the Plaintiff a motor vehicle insurance policy bearing policy number 50218662 -2. A copy of the applicable policy is attached hereto and incorporated by reference herein as Exhibit A. 7. On June 3, 2010, Plaintiff was injured in a motor vehicle collision that was caused by the owner and operator of a vehicle registered in Pennsylvania, Sara Bingaman. 8. At the time of the aforementioned collision, Plaintiff was insured under the above - referenced Progressive policy. 9. At the time of the aforementioned collision, Ms. Bingaman was insured under a motor vehicle policy issued by Defendant, ERIE, and bearing policy number Q061205924H. 10. As a result of the injuries she sustained in the aforementioned collision, Plaintiff has asserted a bodily injury claim against Ms. Bingaman and an action has been commenced in this honorable Court, docketed at 2012 -716. 11. Defendant, PROGRESSIVE, contends that Plaintiff elected-the Limited Tort Option when applying online for the above referenced policy and that, aside from the issue of whether she sustained a serious injury and /or that her injuries create a serious impairment of a bodily function, the Limited Tort Option governs her right to recover damages in both .the third party bodily injury action and her underinsured motorist claim against Defendant, PROGRESSIVE. 12. Defendant, ERIE, is an indispensable party to this action as the declaratory relief sought would affect Plaintiff's rights in the action she filed against, Sara Bingaman, the ERIE insured. 13. Plaintiff contends that her right to recover damages in the third party bodily injury action and her underinsured motorist claim is governed by the Full Tort Option, as she did not make an informed election of the Limited Tort Option pursuant to 75 Pa.C.S. §1705. 14. Plaintiff contends that Defendant, PROGRESSIVE, failed to follow the provisions of 75 Pa.C.S. §1705, thereby preventing Plaintiff from making an election of her tort option and resulting in a presumption that she chose the Full. Tort Option. 15. Defendant, PROGRESSIVE, 'failed to follow the provisions of 75 Pa.C.S. §1705 in the following manner: a. not printing the Notice to Named Insured for reading and signing by Plainiiff as required by 75 Pa.C.S. §1705(a)(2); b not presenting the Notice to Named Insured to Plaintiff with both tort options on one sheet as required by 75 Pa.C.S. §1705(a)(2); c. not presenting the Notice to Named Insured in prominent type as required by 75 Pa.C.S. §1705(a)(2); d. not placing the Notice to Named Insured in a prominent place as by 75 Pa.C.S. §1705(a)(2); e. not having Plaintiff sign a valid Notice to Named Insured as required by 75 Pa.C.S. §1705; and f. in otherwise not properly notifying Plaintiff of her option to choose between the Full Tort and Limited Tort options when and /or after applying for the above referenced policy online as required by 75 Pa.C.S. §1705. WHEREFORE, the Plaintiff, MARIAH L. YANCEY, respectfully requests this Honorable Court issue an Order in the nature of Declaratory Relief, declaring that Plaintiff, MARIAH L. YANCEY, did not make an election of the Limited Tort Option and that her right to recovery in the third party bodily injury action and underinsured motorist claim arising out of the injuries sustained in the June 3, 2010 motor vehicle collision, is governed by the Full Tort Option. YANCEY : CUMBERLAND COUNTY, PENNSYLVANIA vs. : NO. 13-2683 JURY TRIAL DEMANDED PROGRESSIVE PREFERRED INSURANCE COMPANY,et al. : CIVIL ACTION PRELIMINARY OBJECTIONS of DEFENDANT PROGRESSIVE PREFERRED INSURANCE COMPANY Defendant Progressive Preferred Insurance Company, (Progressive) by and through counsel, Ferry Ullman, hereby files the instant Preliminary Objections to Plaintiffs Declaratory Judgment Action and avers as follows: 1. Plaintiff filed a Declaratory Judgment Action against Defendant Progressive Preferred Insurance Company and other Defendants on or about May 13, 2013. A true and correct copy of Plaintiffs' Complaint is attached hereto as Exhibit "A", and made a part hereof. 2. Plaintiff served the Declaratory Judgment Action on Defendant Progressive Preferred Insurance Company on or about May 21, 2013. 3. Plaintifrs Declaratory Judgment Action seeks ajudicial determination as to one issue. The Action seeks to challenge Progressive's online application process for signing the limited tort selection forms pursuant to 75 Pa.C.S.A. Sec. 1705. See Exhibit 4. The sole remedy sought by Plaintiff in the Declaratory Judgment Action is to invalidate the electronic tort selection form completed online by Plaintiff. Plaintiff seeks to be found to be"full tore' for Plaintiff s June 3, 2010 motor vehicle accident claim/suit against tortfeasor Sara Bingaman. See Exhibit"A". 5. Plaintiff has not asserted an underinsured motorist coverage claim against Progressive. Plaintiff has not filed any claim against Progressive except the instant Declaratory Judgment Action. See Exhibit "A". 6. Since Plaintiff has only filed suit against tortfeasor Bingaman, and not against anyone else, Plaintiff s Declaratory Judgment Action does not reference or affect any other pending cause of action. Id. 7. On or about November 2, 2012, over five (5) months prior to the filing of the instant Declaratory Judgment Action, Plaintiff was advised by the insurance carrier for tortfeasor Bingaman, Erie Insurance, that Plaintiff was already determined by Erie to have"suffered... a serious impairment of a body function, and that this injury will pierce the threshold [for full tort]." See letter from Erie to Plaintiff attached hereto as Exhibit "B„ 8. Whether the tort selection forms are valid or not is currently not at issue because Plaintiff had already been found to be"full tort" by the tortfeasor's insurance carrier: Eric Insurance. See Exhibits "A"and "B". 9. Whether the tort selection form is valid or invalid is not currently ripe or relevant since Plaintiff has already been afforded full tort status by Erie Insurance. See Exhibit"B". 10. Currently,there is no controversy regarding the tort selection form at issue. Plaintiff has been advised by the insurer of the tortfeasor that Plaintiff will be allowed to recover non-economic /full tort damages in the only action or claim currently pending. IL "The courts in our Commonwealth do not render decisions in the abstract or offer purely advisory opinions;consistent therewith,the requirement of standing arises from "the principle that judicial intervention is appropriate only when the underlying controversy is real and concrete."City of Philadelphia y;_Commonwealth of Pennsylvania, 575 Pa. 542, 838 A.2d 566, 577(Pa. 2003). 12. The courts should not give answers to academic questions or render advisory opinions or make decisions based on assertions as to hypothetical events that might occur in the future. See, e.g., Bliss Excavating Co. v. Luzerne County, 418 Pa. 446, 211 A.2d 532 (Pa. 1965) (dismissing as not ripe a claim that an ordinance that regulated the business of anthracite strip mining was unauthorized and preempted on the grounds that no attempt had been made to apply the ordinance against the plaintiffs' mining operations); Roeder v. Borough of Hatfield,439 Pa. 241, 266 A.2d 691 (Pa. 1970) (dismissing as not ripe a claim of illegal spot zoning because no action had been taken under the ordinance). 13, The doctrine of ripeness concerns the timing of a court's intervention in litigation. See Town of McCandless v. McCandless Police Assn, 587 Pa. 525, 901 A.2d 991, 1002 (Pa. 2006). The basic rationale underlying the ripeness doctrine is "to prevent the courts, through avoidance of premature adjudication, from entangling themselves in abstract disagreements." Abbott Labs v. Gardner, 387 U.S. 136, 148 (1967). Whether the time is right to adjudicate a claim is an issue that the Pennsylvania courts consider. See Town of McCandless, 901 A.2d at 1002. 14, Pa.R.C.P. 1028(a)(4) allows a party to file preliminary objections due to the"legal insufficiency of pleading." 15. For the reasons set forth herein and in the attached Memorandum of Law, Plaintiffs Declaratory Judgment Action must be dismissed. WHEREFORE.
