TO THE HONORABLE, THE JUDGES OF THE SAID COURT:
Petitioner, William A. Duncan(successor to Hannah B. Miller),trustee under the last will
and testament of Christine S. Ritter, respectfully states the following:
1. Christine S. Ritter("Decedent") died, a resident of Cumberland County, Pennsylvania
on June 27, 1987, leaving a will dated August 19, 1976 and a codicil, which were probated in
the office of the Register of Wills of Cumberland County, Pennsylvania, docketed to Estate No.
21-87-474. A copy of the Will and Codicil is attached hereto as Exhibit"A".
2. Decedent, in the codicil to her will, gave Twenty-five Thousand($25,000.00) Dollars
unto her daughter, Hannah B. Miller, Trustee, to be held in trust for the benefit of Elizabeth Dru
Miller with the remainder to Hannah B. Miller, per stirpes. Payments to Elizabeth Dru Miller
were to be paid in the sole discretion of the Trustee.
3. William A. Duncan currently serves as Trustee with the consents of Hannah B. Miller,
Christine S. Hollinger, May Bright Mongue and Elizabeth Dru Miller.
6. A copy of the current bank statement for the Trust is incorporated herein and attached
hereto as Exhibit"B".
7. Elizabeth Dru Miller, beneficiary of the Trust, is a 39 year old individual who suffers
from a mental disability consisting of inental retardation. She has been diagnosed with moderate
IDD, Intermittent Explosive Disorder, Hypothroidism, Seasonal allergies, Irregular Menses,
Asthma, Asymmetrical breast size and Morbid Obesity. She is unable to live on her own and
must have 24-hour supervision.
8. Elizabeth Dru Miller is currently receiving survivor Social Security benefits, medical
assistance, food stamps and county assistance. She was employed briefly in a sheltered
workshop but was not successful in that endeavor.
9. Given the fact that Dru is placed in a group home which necessitates limiting her
assets, the costs of her prescription medications and anticipated increases in her medical costs, as
well as the necessity of maintaining the assistance given her through county waiver funding, it is
desirable to reform the Trust to create a Special Needs Trust to supplement, rather than supplant,
benefits for her basic needs. This would fulfill the intention of the Testatrix in providing for Ms.
Miller's care for the duration of her life while optimally preserving the trust funds for her benefit
and that of the remainder beneficiaries.
10. The failure of the language in the Decedent's codicil to contain the necessary language
currently required to create a supplemental special needs trust creates a fund which would
disqualify Ms. Miller from receiving the residential placement, medical assistance and other
benefits she currently receives.
11. Petitioner requests that the Court order the reformation of the trust created by
Decedent's will for the benefit of Elizabeth Dru Miller to establish a Special Needs Trust, which
would allow her to receive a small payment to Supplement her current income while enabling her
to remain eligible for medical assistance, food stamps and county assistance programs.
12. Petitioner requests that the terms of the Codicil of Decedent's will be reformed by the
addition of the following:
"I give, devise and bequeath Twenty-five Thousand($25,000.00) Dollars unto the
Elizabeth Dru 1�liller Special Needs Trust and my trustee, Hannah B. Miller or her successor, in
accordance with the terms and conditions set forth in an instrument known as the "Elizabeth Dru
Miller Special Needs Trust" incorporated herein by reference."
13. A copy of the proposed Elizabeth Dru Miller Special Needs Trust is attached hereto,
made a part hereof by reference and marked as Exhibit"C".
14. 20 Pa.C.S. section 711(2)provides, in relevant part:
[T]he jurisdiction of the court of common pleas over the following shall be exercised
through its orphans' court division:
(2) Testamentary trusts. - The administration and distribution of the real and
personal property of testamentary trusts, and the reformation and setting aside of any such trusts,
whether created before or after the effective date of this chapter....
15. 20 Pa.C.S. section 7740.1(b) of the Uniform Trust Act provides, in relevant part:
Modification or termination of non charitable irrevocable trust by consent...(b) consent by
beneficiaries with court approval. -A non charitable irrevocable trust may be modified upon the
consent of all the beneficiaries only if the court concludes that the modification is not
inconsistent with a material purpose of the trust...
16. The terms of the Special Needs Trust are consistent with the terms of the Will, and
with the Decedent's intentions to provide for the needs of Elizabeth Dru Miller for the duration
of her life and also for the benefit Decedent's other granddaughters and their children.
17. The proposed modification of the Trust is not inconsistent with a material purpose of
the trust and is in the best interest of both the life beneficiary and the remainderpersons.
18. The consents of all of the beneficiaries of the said Trust are attached to this petition
as Exhibit"D".
19. This matter has not been assigned to any Judge at any time previous to this filing.
WHEREFORE, Petitioner respectfully requests that this Court enter an Order reforming
the Trust under the Codicil of the Will dated August 19, 1976 of Christine S. Ritter, deceased,
and establishing a Special Needs Trust for the benefit of Elizabeth Dru Miller, with William A.
Duncan serving as successor Trustee to Hannah B. Miller and May Bright Mongue.

ELIZABETH DRU MILLER
Inevocable Trust Agreement
This Agreement made the day , 2Q 13 ,
between CHRISTINE S. RITTER ESTATE FOR$ENEFIT CtF ELIZABETH DRU MILLER,
herein called the Settlor, and The EDM Special Needs Trust, William A. Duncan, Trustee.
Trust Estate. The Settlar hereby transfers to the Trustee and the Trustee hereby
acknowledges receipt af the properiy described in Schedule A attached hereto, which property
the Trustee sha11 hold and manage as pravided herein for the benefit of ELIZABETH DRU
MILLER, in accordance with the provisions hereinafter set forth:
A. No payments shall be rnade from this Trust of either income or principal
until the Trustees shall have taken into cansideration all af DRU's available other assets and
sources of income, including entitlement to benefits or services from any local, state or federal
goverrtment ar agency(or fram any private agency.)
B. During the li�etime of DRU, a11 payments from this Trust which
go to the benefit of her are to be direct payments to the person or entity supplying goods or
services to her at the request of the Trustee.
C. I�uring the life of I�RU, no partion of this Trust,either income or
principal, shall be subject ta anticipation,pledge, assignment ar obligation of DRU nor be
subject ta at�y reimbursement, execution, attachment, levy or sequestratian or any other claims af
or interference from the creditors of DRU or the estate of DRU or of anyone who may be
obiigated far the support of DRU, including any government or governmentai agency or private
agency which has provided benefits or services to DRU.
D. During the lifetime of DRU,no portion of the principai af this
Trust, and for sa long as there exists any ciaim against her or her estate for reimbursement by
any creditor,no portion of the income of this Trust, shall be ar be able ta be used ta provide basic
faod, clothing and shelter for DRU (nor be able to be converted for such items)but rather to
provide DRU with extra supplemental care,maintenance,comfort, happiness and educatian in
additian to and over and above her basic suppart. To this end, the Trustee may pravide such
resources and experiences as will cantribute ta and rnake DRU's life as pleasant, camfortable and
happy as feasibie. Nothing herein shall preclude the Trustee from purchasing those services and
items which prc�mate I7RU's happiness,welfare and development, including,but nat Iimited to,
vacatian and recreation trips away from places of residence, expenses for traveling companions,
if requested or necessary, entertainment expenses,supplemental medical and dental expenses,
social servic�s expenses, transportation costs,private room, telephone and television services, a
mechanical bed, and electric wheeichair, personal care services, and the Iike.
E. During DRU's life sho�td the existence of tl�is Trust disqualify�
her from eligibility for substantial governrnental or ,yrivate aid ar benefits or services or should
any interest of DRU hereunder in the principal while undistributed and in the passession of the
Trustee be subject ta attachment, execution, sequestration ar reimbursement by any creditar,
assignee, subrogee or provider of aid, benefits or services to DRU,then this Trust may, in the
discretion of the Trustee, be terminated and the then remaining principal and interest distributed
to Hannah B. Miller, if living. In the event Hannah B. Miller is deceased,then to May Bright
Mangue and Christine Hollinger, per stirpes.
F. Upan the death af DRU this Trust shall terminate and ail
principal and any accumulated and undistributed income shall be distributed to Hannah B. Miiler,
if living. In the event Hanna,h B. Miller is deceased, then to May Bright Mangue and Christine
Hallinger,per stirpes.
G. In managing the assets canveyed herein and any ather assets subsequently
transferred to this Trust, the Trustee is chazged with the following duties: keep the assets safely;
use the care and attention which a reasonably prudent man would devc�te ta the management of
his own financial affairs considering the econamic conditions of the time;prepare and file ta.x
ret�uns; file any reparts required by the Court; transfer assets for the use of the beneficiaxy of this
trust in accordance with the provisions set forth above as requested by the Settlor or her
designees.
H. Powers of Trustee. In addition to, and not in any way a limitation on,
the powers otherwise granted to the Trustee by the laws of the Commonwealth of Pennsylvania
or by this inshument,the Trustee shall have the following powers: receive proceeds fratn the
sale, maturity, call or conversion af Trust assets; invest in and buy ar sell assets (including real
ar personal property, comman funds managed by the Trustee, and abligatians, deposit accounts,
or stock of the bank or its affiliates); pay any necessary expenses including reasonable Trustee's
compensatian, ailocate transactions between income and princzpal as the Trustee deems best; and
handle routine matters according to the Tntstee's best judgment, including but not limited to
making timely exchange of temparary issues for permanent, executing praxies or voting shares,
buying or selling fractianal shares, and exercising,halding or selling warrants representing rights
received in corporate recapitalizatian or reorganizations.
