Plaintiff is JPMorgan Chase Bank, National Association, duly organized and doing business at the above - captioned address. 2. The Defendant is Frederick Neverman, Jr., who is the mortgagor and real owner of the mortgaged property hereinafter described, and his/her last -known address is 1508 Hunter Road, Verona, PA 15147. 3. The Defendant is Barbara D. Neverman a/k/a Barbara Dale Neverman, who is the mortgagor and real owner of the mortgaged property hereinafter described, and his/her last -known address is 10 Bradford Court, Mechanicsburg, PA 17055. 4. The Defendant is The United States of America, whose last -known address is 228 Walnut Street, P.O. Box 11754, Harrisburg, PA 17108. 5. On July 23, 2003, mortgagors made, executed and delivered a mortgage upon the premises hereinafter described to The Washington Mutual Savings Bank, FSB which mortgage is recorded in the Office of the Recorder of Cumberland County in Mortgage Book 1827, Page 1643, such Mortgage being incorporated herein by reference pursuant to Rule 1019(g) Pa. R. C. P. 6. On July 23, 2003, mortgagors also executed a promissory note secured by the aforementioned mortgage. Plaintiff, directly or through an agent, is in possession of the note and is the holder ofthe note with the right to enforce it; the note is either made payable to plaintiff or has been duly endorsed. 7. The aforesaid mortgage was thereafter assigned by The Washington Mutual Savings Bank, FSB to Washington Mutual Bank, FA and /or assigns, by Assignment of Mortgage, executed on July 30, 2003 and recorded on August 3, 2004 in the Office of the Recorder of Cumberland County in Mortgage Book 710, page 2154, such Assignment of Mortgage being incorporated herein by reference pursuant to Rule 10 1 9(g) Pa. Notice of this lien was filed on November 12, 2008, at the Office of the Prothonotary of Cumberland County, by the Department of the Treasury - Internal Revenue Service, Harrisburg, Pennsylvania. A true and correct copy ofNotice ofFederal Tax Lien is attached hereto and marked as Exhibit "A." 11. On October 6, 2009, the Defendant, United States of America, acquired a lien against the premises hereinafter described in the sum of $66,933.35, subordinate to the mortgagee hereinafter referred to, by reason of Federal Tax Lien, Serial Number 587810209, in favor ofthe United States ofAmerica against Fred & Barbara Neverman, and which is recorded in the Office of Prothonotary of Cumberland, Pennsylvania. 12. Notice of this lien was filed on October 13, 2009, at the Office of the Prothonotary of Cumberland County, by the Department of the Treasury - Internal Revenue Service, Harrisburg, Pennsylvania. A true and correct copy of Notice of Federal Tax Lien is attached hereto and marked as Exhibit « 13. On May 8, 2010, the Defendant, United States of America, acquired a lien against the premises hereinafter described in the sum of $6,516.90, subordinate to the mortgagee hereinafter referred to, File # 57789 Page 5 by reason of Federal Tax Lien, Serial Number 654170610, in favor of the United States of America against Fred & Barbara Neverman, and which is recorded in the Office of Prothonotary of Cumberland, Pennsylvania. 14. Notice of this lien was filed on May 14, 2010, at the Office of the Prothonotary of Cumberland County, by the Department of the Treasury - Internal Revenue Service, Harrisburg, Pennsylvania. A true and correct copy of Notice ofFederal Tax Lien is attached hereto and marked as Exhibit 15. By the filing of this action, Plaintiff seeks a judicial sale of the premises hereinafter described. 16. The premises subject to said mortgage is described in the legal description attached as Exhibit "D" and is known as 10 Bradford Court, Upper Allen Township, Mechanicsburg, Pennsylvania 17055. 17. The mortgage is in default because monthly payments of principal and interest upon said mortgage due December 1, 2010 and each month thereafter are due and unpaid, and by the terms of said mortgage, upon default in such payments for a period of one month, the entire principal balance and all interest due thereon are collectible forthwith. 18.
