addressed to Seth N. Fry to appear and show cause, if any there be, why letters testamentary in
the Estate of Glenn E. Fry, Deceased, should not be granted solely to Petitioner if Seth N. Fry
fails to qualify as Co-Executor, and in support thereof avers as follows:
1. Petitioner is Love F. Baker, the niece of Glenn E. Fry (the "Decedent"), who died
on January 6, 2008, a resident of the Thornwald Home, located at 442 Walnut Bottom Road,
Carlisle, Cumberland County, Pennsylvania. A true and correct copy of the death certificate for
the Decedent is attached hereto and incorporated herein as Exhibit"A."
2. According to the Decedent's death certificate attached as Exhibit "A," Decedent
was never married, and upon information and belief, Decedent also did not have any children.
3. On September 20, 2001, Decedent executed a Last Will and Testament which was
prepared by attorney Hamilton C. Davis.
4. Upon information and belief, Decedent executed the Last Will and Testament
prepared by his attorney in the presence of the Decedent's niece, Hope F. Fry, and the
Decedent's nephew, Seth N. Fry, both of whom acted as subscribing witnesses. A true and
correct copy of the Last Will and Testament dated September 20, 2001, bearing the signatures of
Decedent, his niece and nephew, and a Notary Public, is attached hereto and incorporated herein
as Exhibit"B."
5. Contemporaneously with the filing of this Petition, the Petitioner is filing with the
Register of Wills of Cumberland County the original of Decedent's Last Will and Testament
dated September 20, 2001, a self-proved Will, and filing the necessary accompanying papers for
probate and the grant of letters testamentary.
6. Petitioner and the two (2) subscribing witnesses, Hope F. Fry and Seth N. Fry, are
named as the Co-Executors pursuant to ITEM VI of the document attached as Exhibit"B."
7. Hope F. Fry died on October 6, 2010. A true and correct copy of the death
certificate for Hope F. Fry is attached hereto and incorporated herein as Exhibit"C."
8. Upon information and belief, Seth N. Fry relocated from Newville, Cumberland
County, Pennsylvania, to 1534 West Ridge Street, Apartment 21 B, Marquette, Michigan 49855,
whereupon he cut off all communication with his siblings, including the Petitioner herein.
9. On or about December 9, 2010, the undersigned attorney sent correspondence to
Seth N. Fry requesting information with regard to the Decedent's original Will, and notifying
him that he was one of the Decedent's beneficiaries entitled to portion of his uncle's assets. A
true and correct copy of the correspondence dated December 9, 2010, is attached hereto and
incorporated herein as Exhibit"D."
10. The undersigned attorney has also attempted to contact Seth N. Fry by telephone,
but no one answered the calls, and no other telephone numbers are known for Mr. Fry.
11. Seth N. Fry has failed to respond to the correspondence of the undersigned and
has consistently failed and refused to communicate with his siblings since relocating to
Michigan.

12. Upon information and belief, Seth N. Fry has refused and continues to refuse to
contact the undersigned attorney, contact the Petitioner, or come to the office of the Register of
Wills of Cumberland County to qualify as co-Executor and to complete probate.
13. Petitioner requests that probate be completed and letters testamentary be issued so
that administration of the Decedent's estate may be commenced and completed after
considerable delay.
14. Upon information and belief, Seth N. Fry resides at 1534 West Ridge Street,
Apartment 21B, Marquette, Michigan 49855.
15. It has now been more than five(5)years since the passing of the Decedent, and no
estate has previously been opened in his name.
16. Seth N. Fry has refused to cooperate in the completion of a petition for letters
testamentary, despite being previously requested to do so by his sisters and the undersigned legal
counsel.
17. The failure of Seth N. Fry to cooperate has unduly delayed the probate process
and has already jeopardized the administration of the Decedent's estate in that (a) Petitioner still
does not know the full extent of the Decedent's assets and accounts; (b) Petitioner has not been
able to secure, manage, and properly distribute whatever assets of Decedent that remain; (c)
Petitioner's sister and the other named Co-Executer, Hope F. Fry,has now also passed away; and
(d) Petitioner has been unable to complete and timely file the Pennsylvania lnheritance Tax
Return and pay any and all necessary taxes on behalf of Decedent's estate.
18. Decedent did name Petitioner as a Co-Executor under the copy of his Last Will
and Testament attached hereto as Exhibit "B," and thereby expressed a faith and desire for
Petitioner to serve in that fiduciary capacity.

19. Seth N. Fry has not previously appeared at the Register of Wills Office in and for
Cumberland County, Pennsylvania in order to qualify as Co-Executor, despite more than five (5)
years having passed since Decedent's death.
20. By his actions and refusal to communicate, Seth N. Fry is wasting and
mismanaging the Decedent's assets and has failed to perform duties requested to be performed
by him.
21. The failure of Seth N. Fry to communicate despite being requested to do so, and
the failure to qualify as a Co-Executor constitutes a refusal to serve or a forfeiture of his right to
serve.
WHEREFORE, Petitioner respectfully requests that a citation be awarded and directed
to Seth N. Fry to appear and show cause, if any there be, why letters testamentary in the Estate of
Glenn E. Fry, Deceased, should not be granted solely to the Petitioner, Love F. Baker and the
Last Will and Testament of Glenn E. Fry dated September 20, 2001, should not be admitted to
probate.

EXHIBIT "B"
LAST �'�'ILL A.\D TESTAMENT
I, GLE�r:�1 E. FRY', of Upper Frankforl Township, Cumberland County, Pennsylvania,
declare this to be my Last Will and Testament and revoke any�'ill or Codicil previously made by
me.
ITEM I: I direct that all my just debts (except as may be barred by a Statute of Limitations)
and my funeral expenses (including my gravemarker and expenses of my last illness) shall be paid
from my residuary estate as soon as practicable after my decease as a part of the administration of
my estate.
ITEM II: I bequeath those articles of my household furniture and furnishings and those
articles of my personal effects and personal property as set forth in a separate memorandum (which
is signed by me, dated and makes specific reference to this Will and memorandum, which I shall
place with my Will or deposit with my attorney),to the persons therein designated.
ITEM III: I devise and bequeath the residue of my estate of every nature and wherever
situate in equal shares to such of my nephews and nieces (who are children of my brother Clarence
W. Fry), CLARENCE W. FRY II, JOEL D. FRY, LUKE S. FRY, MARK K. FRY, HOPE F. FRY,
SETH N. FRY, and LOVE F. BAKER,as shall survive me by thirty(30) days.
ITEM N: Should any of my nephews or nieces, CLARENCE W. FRY II, JOEL D. FRY,
LUKE S. FRY, MARK K. FRZ', HOPE F. FRY, SETH N. FRY, and LOVE F. BAKER,
predecease me or die on or before the thirtieth day following my death but leaving descendants who
so survive me, such descendants shall receive, per stiipes, the share that such predeceased nephew
or niece would have received had he or she so survived me.
ITEM V: If any property passes outright (either under this Will or othe��ise) to a minor
(which shall be defined as anyone under twenty-one (21) years of abe) and �vith respect to which I

am authorized to appoint a guardian and have not otherwise specifically done so, I decline to
appoint a guardian but instead authorize my Executor to distribute such property to a Custodian
selected by my Executor (and my Executor may act as such Custodian) as Custodian for the minor
under the Pennsylvania Uniform Transfers to Minors Act. Provided, however, that this appointment
shall not supersede the right of any fiduciary to distribute a share where possible to the minor or to
another for the minor's benefit.
ITEM V: I direct that all taxes that may be assessed in consequence of my death, of
whatever nature and by whatever jurisdiction imposed, shall be paid from the non-charitable portion
of my residuary estate as part of the expenses of the administration of my estate.
ITEM VI: I appoint SETH N. FRY, HOPE F. FRY, and LOVE F. BAKER, co-Executors
of this my Last Will.
ITEM VII: I direct that my executors and custodians or their successors sha11 not be
required to give bond for the faithful perforniance of their duties in any jurisdiction.
ITEM VIII: My individual fiduciary shall be entitled to reasonable compensation for his or
her services rendered from time to time and to reimbursement of out of pocket expenses.
ITEM IX: The interests of the beneficiaries hereunder shall not be subject to anticipation or

Our firm represents the Estate of Hope F. Fry who died on October 6, 2010, As part of
our aclministration of the,estate, we have discovered that there are assets in.the name of Glenn E. :
' Fry who died on January 6, 2008. VVe have not been abie to locate the ariginal will, but we
would like to get the estate apened and adminzstered. Yau are one af the beneficiaries, and as
such would be entitled ta a portian of your uncle's assets.
