Pykosh, Esquire, and files the following Preliminary Objections to the Plaintiff's Complaint, and avers as follows: 1. Plaintiff filed suit against Defendant alleging that Defendant owes money to Plaintiff arising out of an account assigned to Asset Acceptance LLC by HSBC Bank Nevada N A/ Kawasaki. (Plaintiff's Complaint 11). 2. The Complaint was filed on May 20, 2013. First Preliminary Objection - Pa. R.C.P. 1028(a)(2) Failure to Conform to Law or Rule of Court 3. Pennsylvania Rule of Civil Procedure 1028(a)(2) requires dismissal of a complaint if the pleadings fail to conform to law or rule of court. 1 ( t f 4. Plaintiff's Complaint fails to conform to Pennsylvania Rule of Civil Procedure 1019(1), which states, "When any claim or defense is based upon a writing, the pleader shall attach a copy of the writing, or the material part thereof, but if the writing or copy is not accessible to the pleader, it is sufficient so to state, together with the reason, and to set forth the substance of the writing." 5. Plaintiff has failed to attach a copy of the complete writing, more specifically the Loan/Credit Agreement, or the material part thereof. Plaintiff has also failed to state the reason that the writing or copy thereof is not accessible to the Plaintiff, or to set forth the substance of the writing, in violation of Pa. R.C.P. 1019(i). Remit Corporation v. Miller, 5 Pa. D&C 5th 43. 6. Furthermore, Plaintiff is not the original creditor, but rather is an assignee of the original creditor. (Plaintiff's Complaint 11 and 3). Since the Plaintiff's right to maintain an action as an assignee is predicated upon a written assignment or Bill of Sale, that writing must be attached to the Complaint, pursuant to Pa. R.C.P. 1019(1). 7. By failing to attach a copy of the Plaintiff's Bill of Sale from HSBC Bank Nevada NA/Kawasaki, the Complaint does not comply with an express rule of court, and should be dismissed under Pa. R.C.P. 1028(a)(2). Remit Corporation v. Miller, 5 Pa. D&C 5th 43 and Capital One Bank v. Clevenstine, 7 Pa. D&C 5th 153. Second Preliminary Objection- Pa. R.C.P. No. 1028(a)(3) Insufficient Specificity in a Pleading 8. Pennsylvania Rules of Civil Procedure 1019(a) and 1028(a)(3) require that material facts be specified and pleaded in a concise and summary form. 9. The Complaint contains only a general assertion of the amount the Plaintiff claims is owed by the Defendant. It provides insufficient detail as to the date(s) on which 2 the debts were incurred, the amounts incurred on each date, the dates or amount of payments made, and any other fees. 10. By not including the requisite detail of the account, the Complaint fails on insufficient specificity and should be dismissed. Third Preliminary Objection- Pa. R.C.P. 1028(a)(6) Plaintiff Lacks Capacity to Sue 11. Pennsylvania Rule of Civil Procedure 1028(a)(5) requires a Complaint to be dismissed where the Plaintiff lacks the capacity to sue. Pennsylvania Rule of Civil Procedure 2002(a) requires that an action be brought by the real party in interest. 12. By failing to attach a copy of the necessary writing by which the Plaintiff would become the assignee of the account, and thus the real party in interest, or an agency agreement, the Plaintiff has failed to conform with the requirements of the aforesaid rule. 13. Furthermore, the attached Verification fails to state who the undersigned is a representative of, and therefore lacks the authority to verify the facts set forth in the Complaint. 14. Plaintiff has not shown standing or capacity to sue Defendant. 15. Because this matter was not brought by the real party in interest, the Complaint must be dismissed. WHEREFORE, Defendant respectfully requests this Honorable Court sustain his Preliminary Objections and dismiss Plaintiff's Complaint with prejudice. 3 !
