Defendants, Jerald L. Metcalf a/k/a Jerald Metcalf, Christine M. Metcalf a/k/a Christine Metcalf, (collectively, the "Defendants "), are adult individuals and are the real .owners of the premises hereinafter described by virtue of a Deed dated September 14, 2010, recorded September 15, 2010 under Instrument 201025719. The Deed is attached hereto as Exhibit "A" and made a part hereof. 3. Defendant Jerald L. Metcalf a/k/a Jerald Metcalf, upon information and belief, resides at 43 Burgners Mill Road, Carlisle, PA 17015. Defendant Christine M. Metcalf a/k/a Christine Metcalf, upon information and belief, resides at 43 Burgners Mill Road, Carlisle, PA 17015. Defendant THE UNITED STATES OF AMERICA c/o the U.S. Attorney for the Middle District of Pennslvania, upon information and belief, is located at 228 Walnut Street, Suite 220, Harrisburg, PA 17108. 4. On August 2, 2007, inconsideration of a loan in the principal amount of $182,750.00, Defendant Jerald L. Metcalf a/k/a Jerald Metcalf executed and delivered to Countrywide Home Loans, Inc. dba America's Wholesale Lender an Adjustable Rate Note (the "Note ") with interest thereon at 10.680 percent per annum, payable as to the principal and interest in equal monthly installments of $1,649.94 commencing October 1, 2007. The Note is attached hereto as Exhibit "B" and made a part hereof. 5. To secure the obligations under the,Note, Defendants, Jerald L. Metcalf a/k/a Jerald Metcalf, Christine M. Metcalf a/k/a Christine Metcalf executed and delivered to Mortgage Electronic Registration Systems, Inc., solely as nominee for Countrywide Home Loans, Inc. dba America's Wholesale Lender a mortgage (the "Mortgage ") dated August 2, 2007, recorded on September 15, 2010 in the Department of Records in and for the County of Cumberland under Instrument 201025720. The Mortgage is attached hereto as Exhibit "C" and made a part hereof. 6. Plaintiff is proper parry Plaintiff by way of an Assignment of Mortgage recorded January 26, 2012 under Instrument 201202612. The recorded Assignment of Mortgage is attached hereto as Exhibit "D" and made a part hereof 7. The Mortgage secures the following real property (the "Mortgaged Premises "): 43 Burgners Mill Road, Carlisle, PA 17015. A legal description of the Mortgaged Premises is attached hereto as Exhibit "E" and made a part hereof. 8. Defendants, Jerald L. Metcalf a/k/a Jerald Metcalf, Christine M. Metcalf a/k/a Christine Metcalf are in default of their obligations pursuant to the Note and Mortgage because payments of principal and interest due September 1, 2011, and monthly thereafter are due and have not been paid, whereby the whole balance of principal and all interest due thereon have become due and payable forthwith together with late charges, escrow deficit (if any) and costs of collection. including title search fees and reasonable attorney's fees. 9.
