Petition for Grant of Letters of Administration pendente lite
On April 2,2011,the decedent was operating his motor vehicle at approximately 0120 hours,traveling south in
the northbound lanes of Interstate 81, with a blood alcohol content of.28. He died at the scene as a result of
colliding with various northbound vehicles. On March 27,2013,temporary Letters of Administration pendent lite
were issued to Wayne F. Shade,Esquire. Petitioner now requests the issuance of permanent Letters of
Administration pendente lite for the sole purpose of facilitating the prosecution of a personal injury lawsuit
against the personal representative of the decedent on behalf of one of the victims of the decedent,Ginger A.
Clark.
Except as follows: Decedent was not a party to a pending divorce proceeding wherein the grounds for divorce had been established as
defined in 23 Pa.C.S. §3323(g)and was neither the victim of a killing nor ever adjudicated an incapacitated person.
