S&M paving did a driveway for our neighbors, and they often knock on doors in our neighborhood offering to install a new asphalt driveway with left over materials. My neighbors got a hold of me on my cell phone, and I spoke with Mark on the phone and we agreed on a price of $550 for the new driveway. I came home from dinner, and Mark and his crew worked on our driveway. I paid Mark the $550 cash on this same night, even though the job was not finished. Mark had to return 3 times to finish the job because he kept running out of material. Before his last visit, Mark had even stated that he would not finish the job unless I paid him $300 more than initially agreed upon. I told him that we agreed upon $550, and that he should return to finish the work. Upon his last visit, Mark was heating asphalt with our grill lighter in a wheel barrow before laying it on our driveway. The driveway was not properly compacted, as it was not rolled out, but instead a plate tamperer was used. The asphalt that was laid at our home on our driveway was crumbling apart, and in some places was so loose that it was just a pile of black stones. The asphalt rocks were so loose that our car tires would spin out on the driveway, as it is steep, and people have fallen. The "new" driveway installed by S&M Paving was also smaller than the previously existing driveway and it did not extend out as far as the old driveway or as far out as agreed upon. I attempted to call Mark and any other phone number that I could find on record for S&M paving. My phone calls were never answered or returned. I left countless messages asking for Mark to call me back so that we may work this out and get the driveway repaired. It was not until I called Mark from a blocked phone number that he actually took my call. He refused to fix the driveway and told me to go **** myself, and good luck to me finding his address so that I could start the process to get this issue rectified through the court system. I had to search for information on the business, as I was never provided with a business card, contract or receipt. I requested three estimates from three separate asphalt companies for the cost involved in repairing my driveway. All three companies stated in their estimates that the driveway would need torn out before a new one could even be installed. I have attached these estimates. In the meantime, I have decided to remove the asphalt driveway because it was in such poor shape. I have excavated and removed the S&M paving asphalt driveway, and installed a new concrete driveway, as I work with concrete for a living, and am not a professional asphalt installer. The driveway could not wait on a settlement through the court system before being repaired as someone was bound to hurt themselves walking over it. Mark was also supposed to cut the driveway at the top near the garage door and then lay the new asphalt so that water would not get trapped in between the garage door and the driveway. He never did this, and every time it rained I had water pooling up against my garage door. I have attached a picture to show the hump at the top of the driveway near the garage door. I have attached pictures of the Asphalt driveway installed by S&M Paving and pictures of the concrete driveway that I installed with my employees. It should be noted as well that I still attempted to work with S&M Paving even after starting the court process. However, to this date, they never did provide any type of signed document stating that they would rectify the issue as I requested. The amount of payment I am requesting from S&M Paving is the cost of the "middle" priced estimate from asphalt companies to repair the driveway plus the court fees that I had paid. A concrete driveway costs more than an asphalt driveway, however I feel it is fair to ask for the amount to repair the driveway using an asphalt company, and I would eat the cost of the difference due to going with concrete.
