Defendant did not hire Plaintiff to perform on 14 songs. The original endeavor was to re-record 13 original compositions using the studio facilities owned and operated by Plaintiff and using studio: musicians Plaintiff contacted to work on the project. During the recording of the,13 original songs Plaintiff served a dual role, acting as studio musician and.performing and recording the bass parts for those songs. 4. It is admitted that each studio musician was to receive $75 for each song they recorded. 5. Denied. Strict proof is demanded at trial. Plaintiff did not perform "all that was required of him." 6. Denied. Defendant did not approve of Plaintiff's performances in May of 2012. By that time Plaintiff had realized the opportunity he was passing up and had demanded that he be included in the ownership of the songs. This had never been part of the original agreement. After Defendant refused to allow Plaintiff, or any of the other studio players, to become part owners of the recorded material, Plaintiff refused to release to completed projects to Defendant,despite demand. . 7. Denied. Plaintiff received all monies owed to him. However, Plaintiff is still holding the completed recording hostage and will not release them to Defendant, despite demand.
