NOW COMES, James A. Miller, Esquire ('Petitioner") FBr!§ respeptfullym
requests that your Honorable Court grant Petitioner's 'requesf for leave do
withdraw his appearance in the above matter and make Citation Absolute,, and in
support thereof, avers as follows:
1 On April 15, 2013, Petitioner filed to withdraw as counsel in the herein
matter.
2 On April 25, 2013, your Honorable Court entered a Citation to Show
Cause why the relief should not be granted.
3 Proof of Service of the Citation was obtained and filed with the Court,
specifically;
a. Betty BeCoats was served by United States First Class Certified
Mail, Return Receipt number 7005 1820 0007 1257 5831 on May 6,
2013 and proof having been filed with your Honorable Court on
May 21, 2013;
b. Arlester BeCoats, by counsel, was served by United States First
Class Certified Mail, Return Receipt number 7005 1820 0007 1257
5855 on May 2, 2013 and proof having been filed with your
Honorable Court on May 7, 2013; and,
c. David Lutz, Esquire, was served by United States First Class
Certified Mail, Return Receipt number 7005 1820 0007 1257 5848
on April 30, 2013, and proof having been filed with your Honorable
Court on May 7, 2013.
4 No party filed any pleading as to why the relief should not be granted
as required under your Honorable Court's Citation.
WHEREFORE, Petitioner respectfully requests that this Honorable Court
make the Citation Absolute and permit counsel to withdraw from the herein
matter.
