FAMILY SETTLEMENT AGREEMENT AND FINAL RELEASE IN THE ESTATE OF MARY J. ELDRIDGE, DECEASED KNOW ALL MEMBY THESE PRESENTS, that WHEREAS Mary J. Eldridge, late of Cumberland County, Pennsylvania, died testate on March 2, 2012, having first made her Last Will and Testament, which was duly executed on April 14, 2007 and which is duly recorded in I Cumberland County Courthouse, Office of Register of Wills, at File No. 21-12-0455; WHEREAS, Mary J. Eldridge, by the aforesaid Last Will and Testament, named Robert E. Young as Executor of her Last Will and Testament; WHEREAS, Letters Testamentary on the estate of decedent were duly issued on April 18, 2012 by the Register of Wills of Cumberland County and were granted to Robert E. Young, hereinafter called Personal Representative; WHEREAS, under the terms of the Last Will and Testament of Mary J. Eldridge, Article IV, Paragraphs A thru C, One-Fourth (1/4) of the residue of the estate of Mary J. Eldridge will be distributed to each of decedent's children, Robert E. Young, Marguerite Keller, and Dorothy J. Payne; WHEREAS, Article IV, Paragraph D of the Last Will and Testament of Mary J. Eldridge, One-Fourth (1/4) of the residue of the estate of Mary J. Eldridge will be held in a Special Supplemental Care Trust for the benefit of decedent's daughter,Anne E. Kerr; WHEREAS, Article IX of the Last Will and Testament of Mary J. Eldridge appoints Robert E. Young, as Trustee of the Special Supplemental Care Trust for the benefit of Anne E. Kerr; { WHEREAS, the Personal Representative has gathered the assets of the estate of the decedent, and the assets consist of real and personal property to a total value of$241,963.28 as set forth in a statement of account of the said Personal Representative which is attached hereto and made a part hereof and marked Exhibit A; WHEREAS, Robert E. Young, Marguerite Kellar, Dorothy J. Payne and Robert E. Young, Trustee for the Special Supplemental Care Trust fbo Anne E. Kerr, each received a partial distribution of their distributive shares on or about March 14, 2012; WHEREAS, Robert E. Young, Marguerite Kellar, Dorothy J. Payne and Robert E. Young, Trustee for the Special Supplemental Care Trust fbo Anne E. Kerr, each received a second partial distribution of their distributive shares on or about June 25, 2012; and WHEREAS, the balance for distribution as shown in the statement marked Exhibit A will be distributed as set forth on Exhibit A in accordance with the terms of the Last Will and Testament of the decedent. NOW, THEREFORE, KNOW YE, that we, Robert E. Young, Marguerite Keller, Dorothy J. Payne, and Robert E. Young, Trustee for the Special Supplemental Care Trust fbo Anne E. Kerr, being the beneficiaries, heirs and trustees of the decedent, and being those persons entitled to inherit under the Last Will and Testament, do hereby acknowledge that we have received partial distributions and will receive a final distribution from the Personal Representative, in full satisfaction and payment, all sum or sums of money, legacies, bequests and devices as are given, devised and bequeathed to us, and which amounts are set opposite our names in the table and schedule of distribution in the statement attached hereto and marked Exhibit A. AND, we do hereby stipulate that in order to avoid the expense and time involved in the filing of a formal account and schedule of distribution in the Orphans' Court Division of the Court of Common Pleas, we agree that no account is necessary; and we do hereby consent to distribution being made without the filing of an account and schedule of distribution with the Orphans' Court, the same to be with the same force and effect as if it had been filed and confirmed by the Orphans' Court Division of the Court of Common Pleas, Cumberland County, Pennsylvania. THEREFORE, we and each of us do hereby remise, release, quit claim and forever discharge the Personal Representative, Robert E. Young, his heirs, executors, administrators, successors and assigns, of and from the estate and from all actions, suits, payment, accounts, reckoning, claims and demands whatsoever for or by reason thereof, or for any other use, matter, cause or thing whatsoever touching upon the estate of the decedent; and each of us do further hereby covenant and agree that should any liability come due to the estate of the decedent after the signing of this agreement, each of us do hereby covenant and agree with each other and the Personal Representative that we will contribute pro rata our share of the estate to satisfy any and all claims, demands, suits or causes of action which may be successfully prosecuted against the estate or the Personal Representative after the signing, sealing and delivery of this Family Settlement Agreement and Final Release.
