TALERICO as Personal Guarantor Defendant(s) COMPLAINT The Plaintiff, C A CURTZE, CO., by its attorneys, KODAK LAW OFFICES, P.C., brings this action of Assumpsit against the Defendant(s) to recover the sum of SIX THOUSAND NINE HUNDRED TWENTY -THREE DOLLARS AND SEVENTY -SIX CENTS ($6,923.76) along with interest thereon at the statutory rate from August 2, 2012, together with any and all court costs incurred by Plaintiff, upon a cause of action of which the following is a statement: 1. The Plaintiff, C A CURTZE, CO., is a corporation organized and existing under the laws of the Commonwealth of Pennsylvania, having its principal office and place of business at 1717 East 12 Street, Erie, Pennsylvania 16511. 2. The Defendant, MATTHEW A. TALERICO t/a JABRONEE LLC dba Jabronee's Pizza & Buffet, is an adult individual with an address and /or place of business at 314 South 10 Street, Lemoyne, Cumberland County, Pennsylvania 17043. 3. The Defendant, MATTHEW A. TALERICO, personal Guarantor for Jabronee LLC dba Jabronee's Pizza & Buffet, is an adult individual with an address or place of F: \USER \Z MASTER CMP FILES \C \C A CURTZE v Jabronee Talerico 38883 rzs.wpd 2 business at 314 South 10 Street, Lemoyne, Cumberland County, Pennsylvania 17043. 4. Defendant, JABRONEE LLC dba Jabronee's Pizza & Buffet, is a purported LLC, however, no corporation information could be located as more fully set forth on the Pennsylvania Department of State Corporation Bureau print outs attached hereto, collectively marked Exhibit "A" and made a part hereof. 5. Defendant(s) submitted a Credit Application and Personal Guaranty to Plaintiff, which credit was granted to Defendant(s), a true and correct copy of which is attached hereto, marked Exhibit "B" and made a part hereof. 6. On the dates, in the amounts, and for the prices set forth in a true and correct copy of the Plaintiff's hereto attached, marked Exhibit "C" and made a part hereof, Plaintiff, at the special instance request of the Defendant(s), sold and delivered goods, wares and merchandise and /or performed labor and provided services of the kind and description set forth on said Exhibit to the total amount of Five Thousand Seven Hundred Sixty -Nine Dollars and Eighty Cents ($5,769.80). 7. The prices charged for said goods, wares and merchandise and /or labor and services provided were just and reasonable, were the legal and market prices therefor and were the prices which the Defendant(s) promised and agreed to pay to Plaintiff. 8. Due to the default of Defendant(s), and pursuant to the terms and conditions of the F: \USER \Z MASTER CMP FILES \C \C A CURTZE v Jabronee Talerico 38883 rzs.wpd 3 Credit Application and Personal Guaranty executed by Defendant(s) hereto attached as Exhibit "B ", attorney's fees in the total amount of One Thousand One Hundred Fifty -Three Dollars and Ninety -Six Cents ($1,153.96) have been added to said account. 9. Plaintiffs Invoices are not attached to this pleading due to the voluminous nature of same and have previously been provided to Defendant(s). 10. Plaintiff frequently demanded payment from Defendant(s) of said amount due and owing as aforesaid, but Defendant(s) refused and neglected and still refuse and neglect to pay said amount or any part thereof.
