HAMPTON BAYS CORPORATION Defendant. : IN THE COURT OF COMMON PLEAS : CUMBERLAND COUNTY, PENNSYLVANIA : CIVIL ACTION - LAW : CASE NO. 02-813 CIVIL TERM COMPLAINT NOW COMES Seifext, Ltd., by and through its counsel, Clark Law Office, who brings this Complaint against Hampton Bays Corporation and who avers in support thereof as follows: 1. Plaintiffis Seifert, Ltd. ("Seifert"), a Pennsylvania corporation having an address at 145 Salem Church Road, Mechanicsburg, Cumberland County, PA 17055. Defendant is Hampton Bays Corporation ("Hampton"), a Pennsylvania corporation having an address for service of process at 458 Wyoming Avenue, Kingston, Luzerne County, PA 18704. 3. Seifert performs construction labor for construction companies and contractors. 4. On information and belief, Hampton is a contractor. 5. Hampton phoned Seifert at Seifert's place of business in Mechanicsburg, Cumberland County, requesting that Seifert provide certain labor on a construction project performed by Hampton known as the Ricketts Glen Office and Visitor Center (the "Project"). 6. Seifert agreed in said phone call to provide labor to Hampton for the Project, subject to Seifert's standard labor rates and Seifert's terms and conditions for payment. 7. Seifert's terms and conditions for payment are included on a time sheet submitted to the contractor on behalf of each Seifert worker, and invoiced to Hampton with a statement detailing each worker's wage rote. 8. A time sheet for each worker is presented to the contractor each week and initialing to indicate agreement with the hours shown and the terms and conditions listed. 9. Beginning in or about September 2001, and continuing through January 9, 2002, Seifert furnished labor to Hampton for the Project, all indicated by time sheets of Seifert employees that were initialed by Hampton's representative on the Project. 10. At all relevant times when Seifert employees were on the Project site, Hampton's representative specifically praised Seifert's representative for the quality workmanship of Seifert employees on the Project. 11. At no time when Seifert employees were on the Project site did Hampton's representative state to Seifert's representative that the Seifert employees failed to provide quality workmanship. 12. As of January 9, 2002, Hampton's balance due Seifert for labor provided on the project was $11,341.33; a tree copy of the time sheets together with wage rate and invoice documents representing said balance due are attached as Exhibit A and made a part of this Complaint. 13. Hampton has refused to pay the outstanding balance of$11,341.33, despite Seifert's demand for payment. 14. The time sheets together with wage rate and invoice documents establish a contract between Hampton and Seifert. 15. Hampton is in breach of the contract. 16. As a direct consequence of the breach, Seifert has suffered damages as follows: a. $11,341.33, representing the outstanding balance due and unpaid under the contract; b. Agreed-upon interest on the outstanding balance at the rate of 1½ % per month, for a total amount to be determined at trial; and c. Agreed-upon collection costs of suit and reasonable attorney fees, for a total amount to be determined at trial. WHEREFORE, Seifert, Ltd demands judgment in its favor and against Hampton Bays Corporation, in an amount not in excess of the jurisdictional limit for jury trial in Cumberland County, to include damages as set forth above, plus interest, costs and reasonable attorneys fee, plus such other relief as may be just.
