NOW COMES the Borough of Mechanicsburg Cumberland County,
Pennsylvania, by its attorney Lisa Marie Coyne, Esquire, and files the within claim
for charges assessed with respect to sewer and /or refuse rates against above
named owner or owners and against the hereinafter described real estate as
follows:
STATEMENT OF CLAIM
1. This claim is filed by the Borough of Mechanicsburg, a borough organized
and existing in accordance with the laws of the Commonwealth of
Pennsylvania.
2. The owner or reputed owner of the property, or party or parties
responsible or liable, for which this claim is filed is the Defendant(s).
3. The authority under which the sewer and /or refuse rates were changed
and assessed is the Act of July 18, 1935, P.L. 1286, Section 1, 53 P.S. § 2231,
as amended.
4. Plaintiff has made demands for payment for services; however,

Defendant(s) have not made payments for the services provided. ,�- �419 7 �
5. The authority under which this claim is filed is the Act of May 16, 1923
P.L. 207, Section 9, et se g., 53P.S. §7143, as amended.
6. A description of the property against which this claim is filed is:

Cumberland County
Pennsylvania 17055
TAX PARCEL NUMBER 16 -24- 0787 -127
7. This claim has not been the subject of any previous claim and judgment
in the Court of Common Pleas of Cumberland County for sewer and /or
refuse charges.
8. The total amount of the charges for which this claim is filed is
seven hundred sixty four dollars and forty six cents ($764.46), plus costs and
reasonable attorney's fees.
9. The time period for which these charges are filed is April 1, 2012 to May 31,
2013 on Sewer and Refuse Account 1492 -0.
WHEREFORE, Claimant requests that a Municipal Lien be entered in its
favor and against the Defendant in the amount of seven hundred sixty four dollars
and forty six cents ($764.46), plus cost and reasonable attorney's fees.

Witnesseth, that the Grantors, for and in consideration of

made by John C. Brilhart, Registered Surveyor, on July 16, 1968, as follows, to wit:
BEGINNING at a point at the intersection of the center line of Marble Street with the center
line of South Market Street; thence along the center line of South Market Street, South 17
degrees 27 minutes 30 seconds East, a distance of one hundred nineteen and five hundredths
(119.05) feet to a point in the same at corner of other lands now or formerly of the Estate of
Charles A. Markley, deceased, South 72 degrees 58 minutes 10 seconds West, a distance of one
hundred sixty-nine and twenty hundredths (169.20) feet to a point in the center line of said
Weaver Alley (twenty feet wide); thence along the center line of said Weaver Alley, North 17
degrees 20 minutes 10 seconds West, a distance of one hundred five and fifteen hundredths
(105.15) feet to a nail in the center of West Marble Street; thence along the center line ofsaid

West Marble Street, North 68 degrees 15 minutes East, a distance of one hundred sixty -nine and
thirty -three hundredths (169.33) feet to a point in the center of South Market Street, the point
and place of BEGINNING.
SAID PREMISES being improved with a two story dwelling house known and numbered as 504
South Market Street, Mechanicsburg, Pennsylvania, and two 92) garage buildings.
BEING the same premises which Roger L. Flynn and Angela R. Flynn by deed dated July 23, 1996
and recorded in the Recorder of Deeds Office in Cumberland County, Pennsylvania in Deed Book
143, Page 573 granted and conveyed unto David J. Roff and Kathy L. Roff, husband and wife,
grantors herein.
Together with all and singular the buildings, improvements, ways, woods, waters, watercourses,
rights, liberties, hereditaments and appurtenances to the same belonging or in anywise
appertaining; and the reversion and reversions, remainder and remainders, rents, issues and
profits thereof, and of every part and parcel thereof; And Also all the estate, right, title, interest,
use, possession, property, claim and demand whatsoever of the Grantors both in law and in
equity, or, in and to the premises herein described and every part and parcel thereof with the
appurtenances. To Have And To Hold all and singular the premises herein described together
with the hereditaments and appurtenances unto the Grantees and the Grantees' proper use and
benefit forever.
And the Grantors covenant that, except as may be herein set forth, they do and will Specially
Warrant and Defend the lands and premises, hereditaments and appurtenances hereby
conveyed, against the Grantors and all other persons lawfully claiming the same or to claim the
same.
In all references herein to any parties, persons, entities or corporations, the use of any
particular gender or the plural or singular number is intended to include the appropriate gender
or number as the text of the within instrument may require.
Wherever in this instrument any party shall be designated or referred to by name or
general reference, such designation is intended to and shall have the same eject as if the words
"heirs, executors, administrators, personal or legal representatives, successors and assigns" has
been inserted after each and every such designation.
