With z respect to the bequests in ITEM IV.A. 1, a similar provision is included in the Will of Frederick Joseph DeFelice executed this date and it is our intention that each legatee receive only one such bequest so that the bequests are not doubled in the event Frederick Joseph DeFelice and I die under circumstances which make it impossible to determine which survived the other. In such event, one half of each such bequest should be paid from each estate. 2 . The balance shall be divided into two (2 ) equal shares and paid as follows : a. One-half unto My Trustee, in trust, for the benefit of Frederick Joseph DeFelice ' s son, Fred Albert DeFelice (the "Fred Albert DeFelice Trust" ) , and My Trustee shall hold, invest and reinvest, collect the income therefrom, pay all taxes and other charges �� that are made properly against the said trust, and distribute the income and principal thereof as follows : i. During the period of said trust for Frederick Joseph DeFelice ' s son, Fred Albert DeFelice, My Trustee shall apply v so much of the principal and income of the trust as is, in the sole and complete discretion of My Trustee, necessary for the care, support, maintenance, and education of Frederick Joseph DeFelice ' s son, Fred Albert DeFelice. Provided, however, My Trustee is directed to accumulate and add to principal the entire net income of the trust fund if, in the opinion of My Trustee, the expenditure of income or principal is not required to meet the needs of Frederick SAIDIS,GUIDO, Joseph Defelice ' s son, Fred Albert 5HUFF& DeFelice, for the following purposes : MASLAND food, clothing, shelter, health services 2109MazketStreet riOt provided by others; radios, record CampHill,PA players, television S@tS� vacations, movies and other forms of suitable entertainment; trips; pocket money and money to purchase appropriate gifts for 3 _ __ _ _ _ relatives and friends . My Trustee is under no obligation to expend principal for such needs, but if My Trustee, in its sole discretion, does decide to do so, My Trustee shall, under no circumstances, pay or reimburse any amounts to the State of New York, the Commonwealth of Pennsylvania or to any other state or to any subdivision thereof for any purpose, including the care, support, maintenance and education of Frederick Joseph DeFelice ' s son, Fred Albert DeFelice. My Trustee is further directed, in making aziy distribution to Frederick Joseph DeFelice ' s son, Fred Albert DeFelice, to consider the advisability of making such distribution in light of amounts to which Frederick Joseph DeFelice ' s son may be entitled from any governmental agency, -� including but not limited to Social Security Administration Benefits, Veterans Administration Benefits, Medicaid (Medical Assistance) and Supplemental Social Security Income (SSI ) Benefits . � ii. It is m ex ress desire and intention to Y P design the trust created for Frederick Joseph DeFelice ' s son, Fred Albert DeFelice, to be primarily for his benefit, to assure that he will have a friend, advocate or protector of his legal rights, to ensure the he will receive the services that will assist him in developing his maximum potential and in ar_hieving a reasonable degree of normalcy and happiness, to supplement his earnings and governmental benefits, if SAIDIS,GUIDO, any, and not to pay for his lodging, food, medical, dental and hospital SHUFF& expenses when he could otherwise claim MASLAND these from another source. In this 2109MarketStreet regard, I direct My Trustee to perform CampHill,PA certain special functions, which may be compensable to My Trustee, to assure satisfactory completion of my designs and intentions in this my Will . Specifically 4 I direct My Trustee to take the following actions : aa. To assist Frederick Joseph DeFelice ' s son in obtaining Social Security Administration Benefits, Veterans ' Administration Benefits, Medicaid (Medical Assistance) and supplemental Social Security Income Benefits and to collect, expend, and account separately for all such governmental assistance benefits . � My Trustee shall not co-mingle any such benefits with the trust fund; �� nor shall My Trustee co-mingle any of Frederick Joseph DeFelice ' s said � son ' s own assets and income with � said trust fund. -� bb. To personally visit Frederick Joseph 1 DeFelice ' s said son at his residence � periodically to inspect his living � conditions, to inquire of the staff and especially of Frederick Joseph DeFelice ' s son regarding his treatment by the care provider (if any) ; to let Frederick ,7oseph DeFelice ' s son know that he has a friend or advocate; to see that he has spending money for things he wants; to know that he is receiving education, work training, and social and recreational programs . iii. Upon the death of Frederick Joseph DeFelice ' s son, Fred Albert DeFelice, the trust shall terminate and the then remaining principal and undistributed income of this trust shall be distributed SAIDIS,GUIDO, one-half to my daughter, Jeanne Maria SHUFF& Stumpf, one-fourth to my daughter, Lisa MASLAND Marie Willaman, and one-fourth to my son, 2109 Mazket Sueet Gregory John Stumpf .
