Neal, Assistant Counsel, Pennsylvania Department of Corrections, hereby move this Court to strike or, in the alternative open, the judgment entered in this action for the following reasons: 1. Dashawn Jamison ("Plaintiff'), is an inmate currently incarcerated at the State Correctional Institution at Camp Hill ("SCI-Camp Hill"). 2. The Defendants are the following employees from SCI-Camp Hill: Corrections Officer Adam Huber, Sergeant Thomas Cook, Unit Manager Chambers, Mailroom Supervisor Tonya Heist, and Former Deputy Superintendent Jeffrey Ditty. 3. In his Complaint in this action, filed pursuant to 42 U.S.C. § 1983 and state law, Plaintiff alleges that Defendant Huber and/or Heist lost or intentionally destroyed 300 photographs. Plaintiff alleges that Defendants Ditty and Chambers were aware that Officer Huber had a history of being accused by prisoners of assault and destroying property. Plaintiff also alleges that Sergeant Cook destroyed a grievance that Plaintiff intended to submit against Officer Huber for destruction of his property. 4. Plaintiff seeks compensatory damages. 5. This Court, by order dated June 25, 2013, granted Plaintiff's in forma pauperis ("IFP") application. 6. The Complaint was served at SCI-Camp Hill on July 18, 2013. 7. On October 3, 2013, Plaintiff filed a praecipe to enter default judgment. Plaintiff attached a certificate that he had attached a written notice of intention to prison request slips directed to the Defendants through the institution's inter-office mail system. 8. Plaintiff's notice of intention was not delivered to the individual Defendants. 9. The judgment was entered on the docket on October 3, 2013 and was delivered to SCI-Camp Hill on October 10, 2013. The Judjrment is Void and Must be Stricken Due to Improper Service of Complaint 10. "Service of original process upon the Commonwealth...shall be made at the office of the defendant and the office of the attorney general by handing a copy to the person in charge thereof." Pa. R.C.P. 422(a) (emphasis added). 2 11. In actions against Commonwealth parties, service of process must be made at the principal office or local office of the Commonwealth agency being sued, and at the office of the Attorney General General. 42 Pa. C.S. §8523; see also Pa. R.C.P. 422 (relating to service on the Commonwealth and political subdivisions). 12. As a result of Plaintiff's failure to properly serve the complaint, this Court lacked personal jurisdiction over the Defendants. 13. Accordingly, the judgment must be stricken. Judgment is Void and Must be Stricken Due toPlaintiff's Failure to Serve Defendants With Notice of Intention to File Praecipe for Default 14. Rule 237.1 provides that default judgment may not be entered unless the Plaintiff"includes a certification that a written notice of intention to file the praecipe was mailed or delivered at least ten days prior. Pa. R.C.P. 237.1(a)(2). 15. Rule 440 provides for service of legal papers by "handing a copy to the party or by mailing a copy to or leaving a copy for the party at...the place of business of the party." Pa. R.C.P. 440 16. Plaintiff served both his notice of intention and his praecipe for default via request slips that were directed through internal institutional mail. 17. Use of inter-office mail or internal prison mail is not permitted under Rule 440 for service of legal papers. 3 18. Therefore, default judgment should not have been entered and should be stricken. Judgment Should be Entered Because Failure to Respond to Plaintiff's Complaint was an Oversight by Defendants' Counsel 19. Plaintiff's complaint was forwarded to the undersigned counsel for representation of the Defendants after service of the complaint at SCI-Camp Hill. 20. At the time that Plaintiffs complaint was received, the undersigned was in the process of moving offices and placed the file with other file folders intending to enter a deadline for responding to the complaint after computer access was restored. However, due to an oversight, the deadline was not calendared. 21. Because no deadline was entered on counsel's calendar, the undersigned was unaware that the deadline for responding had passed or that Plaintiff had filed a praecipe for entry of default judgment. 22. Staff at SCI-Camp Hill received copies of the notices of entry of judgment on October 10, 2013. Due to the holiday weekend, the undersigned did not receive copies of the judgments until the afternoon of October 14, 2013. 23. Because the failure to respond was the result of oversight of Defendants' counsel, the default judgment should be opened and Defendants' answer to the complaint should be accepted. 4 24.
