O 4 1, 4 Y 68 3 Page I COMPLAINT IN MORTGAGE FORECLOSURE 1. Plaintiff is JPMorgan Chase Bank, National Association, duly organized and doing business at the above - captioned address. 2. The Defendant is Monica Gail DeMariano, Administratrix of the Estate of Sherman Hinkley, deceased mortgagor and real owner. 3. On November 17, 2000, Sherman R. Hinkley, deceased mortgagor and real owner, made, executed and delivered a mortgage upon the premises hereinafter described to Patriot Bank which mortgage is recorded in the Office of the Recorder of Cumberland County in Mortgage Book 1653, Page 98 ( "the Mortgage "), such Mortgage being incorporated herein by reference pursuant to Rule 1019(g) Pa. R. C. P. 4. On November 17, 2000, Sherman R. Hinkley also executed a promissory note secured by the aforementioned mortgage. Plaintiff, directly or through an agent, is in possession of the note and is the holder of the note with the right to enforce it; the note is either made payable to plaintiff or has been duly endorsed. 5. The Mortgage was assigned by Patriot Bank to Homeside Lending, Inc., by Assignment of Mortgage, recorded on January 19, 2001 recorded in the Office of the Recorder of Cumberland County in Assignment of Mortgage Book 684, page 808, such Assignment of Mortgage being incorporated herein by reference pursuant to Rule 1019(g) Pa. R. C. P. 6. The Mortgage was assigned by JPMorgan Chase Bank, National Association, successor in interest by purchase from the Federal Deposit Insurance Corporation as Receiver of Washington Mutual Bank F /K /A Washington Mutual Bank, FA successor in interest to HomeSide Lending, Inc. to JPMorgan Chase Bank, National Association, Plaintiff herein, by assignment of mortgage executed on April 18, 2013 and recorded on April 26, 2013 in the office of the recorder for Cumberland County as Instrumerit Number 201313456. Such Assignment of Mortgage being incorporated herein by reference pursuant to Rule 1019(g) Pa. R. C. P. 7. On October 21, 2011, Sherman R. Hinkley departed this life. The premises subject to said mortgage is described in the legal description attached as Exhibit "A" and is known as 700 East Marble Street, Mechanicsburg, Pennsylvania 17055. 9. The mortgage is in default because monthly payments of principal and interest upon said mortgage due'February 1, 2011 and each month thereafter are due and unpaid, and by the terms of said mortgage, upon default in such payments for a period of one month, the entire principal balance and all interest due thereon are collectible forthwith. 10.
