COMPLAINT FOR DECLARATORY JUDGMENT AND NOW, comes the Plaintiff, Melinda Jo Benyou, by and through her counsel, Tucker Arensberg, P.C., and files the following Complaint for Declaratory Judgment, averring as follows: 1. Plaintiff, Melinda Jo Benyou, is an adult individual with a place of residence located at 441 Hummel Avenue, Lemoyne, PA 17043. 2. Defendant, David E. Keller, is an adult individual believed to be residing at 600 Humphrey Court, Apartment 102, Harrisburg, Pennsylvania 17109. 3. On or about July 7, 2012, Ms. Benyou and the Defendant entered into a sales agreement for the purchase of a 1999 Harley Davidson Dynaglide motorcycle, bearing vehicle identification number 1 HD1 GGV1 8XY305797, for a purchase price of $5,900.00, plus tax, costs of transfer and registration, totaling $6,344.50. A true and correct copy of the Purchase Order is attached hereto as Exhibit "A" and incorporated herein as though set forth at length. 4. Ms. Benyou paid for the Motorcycle by check number 1861, dated July 7, 2012. A true and correct copy of the Check is attached hereto as Exhibit "B" and incorporated herein as though set forth at length 5. The Motorcycle is currently jointly titled in the names of Ms. Benyou and the Defendant, with rights of survivorship. A true and correct copy of the Certificate of Title is attached hereto as Exhibit "C" and incorporated herein as though set forth at length. 6. There is no lien encumbering the Title of the Motorcycle. 7. On or about July 8, 2012, Ms. Benyou and the Defendant purchased miscellaneous gear and accessories for use with the Motorcycle, totaling $567.13. A true and correct copy of the Receipt is attached hereto as Exhibit "D" and incorporated herein as though set forth at length. 8. Ms. Benyou and the Defendant each maintained possession of their respective gear and accessories. 9. On or about July 9, 2012, Ms. Benyou obtained insurance for the Motorcycle. True and correct copies of the Temporary Financial Responsibility Identification Card and Payment Receipt are collectively attached hereto as Exhibit "E" and incorporated herein as though set forth at length. 10. Ms. Benyou financed the purchase of all of the above transactions by obtaining a $7,000.00 Signature Loan from PSECU, on or about July 5, 2012. A true and correct copy of the Approval Letter from PSECU is attached hereto as Exhibit "F" and incorporated herein as though set forth at length. 11. The proceeds from the PSECU Loan were deposited into Ms. Benyou's checking account maintained at Members 1 and all of the above transactions were completed through this account via the check attached as Exhibit "B" and the bank card issued for this account. A true and correct copy of the July 2012 Statement of Account identifying the relevant transactions is attached hereto as Exhibit "G" and incorporated herein as though set forth at length. 12. The Defendant only contributed $700.00 toward all of the above transactions. 13. Ms. Benyou and the Defendant no longer reside together and are no longer in an amicable relationship. 14. Ms. Benyou has maintained possession of the Motorcycle at all times since its purchase and the Motorcycle remains in Ms. Benyou's possession at present. 15. Ms. Benyou is still obligated to PSECU and continues to make monthly payments for the Signature Loan that was obtained to finance all of the above transactions. 16. The Defendant has made no additional contributions, financial or otherwise, toward all of the above transactions beyond the $700.00 referenced in paragraph 12. 17. Despite repeated requests, Ms. Benyou has not been able to obtain the Defendant's signature on the Title in order to remove his name from the Title, thus prohibiting Ms. Benyou from obtaining a clear Title to the Motorcycle and prohibiting her from being able to either renew the registration or to transfer the Title. COUNT I - DECLARATORY JUDGMENT 18. The averments of Paragraphs 1 through 17 of this Complaint for Declaratory Judgment are incorporated herein by reference as thought set forth at length. 19. Ms. Benyou brings this action pursuant to the Pennsylvania Declaratory Judgments Act, 42 Pa.C.S.A. §7531 et seq., requesting that this Honorable Court declare the rights, status or other legal relations between the parties relating to Title to the 1999 Harley Davidson Dynaglide motorcycle, bearing vehicle identification number 1 HD1 GGV18XY305797. 20. As described more fully above, Ms. Benyou financed all of the above transactions through the PSECU Signature Loan and all of the above transactions were accomplished utilizing Ms. Benyou's Members 1 St checking account. 21. The Defendant has only contributed a total of $700.00, which approximately equals the cost of the gear and accessories that he maintained possession of after the two ceased residing together, as well as his portion of the insurance during the time that he utilized the Motorcycle. 22. Ms. Benyou remains obligated to PSECU for the Signature Loan that was obtained to finance all of the above transactions. 23. Due to the Defendant's refusal to sign off on the Title, Ms. Benyou is prohibited from obtaining a clear Title to the Motorcycle and prohibited her from being able to either renew the registration or to transfer the Title. 24. Pursuant to the Pennsylvania Declaratory Judgments Act, 42 Pa.C.S.A. §7531 et seq., Ms. Benyou seeks a declaration from this Honorable Court that: Ownership and Title of the 1999 Harley Davidson Dynaglide motorcycle, bearing vehicle identification number 1 HD1 GGV18XY305797, shall be vested solely in Melinda Jo Benyou, and any right, title or interest of David E. Keller is hereby extinguished.
