Kipp, by and through his counsel, Johnson, Duffie, Stewart & Weidner, P.C., who file this Complaint by respectfully stating the following: 1. On April 29, 2004, Plaintiff was the owner of a 1992 Plymouth Voyager minivan. 2. Plaintiff was operating his vehicle southbound on Inlterstate 83 wherein he was rear- ended by a vehicle operated by Defendant Campbell. 3. The vehicle Defendant Campbell was operating was owned by Defendant Burwell. 4. Defendant Burwell permitted Defendant Campbell to operate the vehicle knowing that the vehicle did not have insurance coverage. 5. The collision between Defendants' vehicle and Mr. Kipp's vehicle is directly and proximately caused by the negligence of Defendants. 6. The collision caused damage in the amount of $1 ,'634.63 to Plaintiff's vehicle. Additionally, Mr. Kipp was forced to incur a rental expense of $103.00 while his vehicle was being repaired. Consequently, Mr. Kipp has suffered a loss in the amount of $1,737.63. COUNT I Kenneth L. Kipp v. Roy Campbell 7. Plaintiff hereby incorporates the averments contained in paragraphs 1 through 6 above as if set forth herein at length. 8. The above-referenced collision was directly and proximately caused by the negligence of Defendant Roy Campbell in that he: a. Failed to use reasonable care in the operation of his vehicle; b. Failed to keep his vehicle under proper and adequate control so as to avoid a collision with Mr. Kipp's vehicle; c. Failed to keep a proper lookout for other vehicles on the roadway; d. Operated his vehicle at a speed in excess of what is reasonable under the circumstances; e. Failed to bring his vehicle to a complete stop within the assured clear distance ahead rule. 9. As a direct and proximate result of Defendant Campbell's negligence, Plaintiff has suffered damages in the amount of $1 ,737.63. WHEREFORE, Plaintiff demands judgment against Defendants jointly and severally in the amount of $1 ,737.63 together with interest, delay damages, and costs of suit. 2 COUNT II Kenneth L. Kipp v. Defendant Burwell permitted the use of her automobile knowing that it was not insured and as such negligently entrusted said vehicle to Roy Campbell. 12. As a result of Defendant Burwell's negligence, Plaintiff has suffered damages in the amount of $1,737.63. WHEREFORE, Plaintiff demands judgment against Defendants jointly and severally in the amount of $1,737.63 together with interest, delay damages, and costs of suit.
