COMPLAINT-CIVIL ACTION
Plaintiff, Chase Manhattan Bank USA, N.A., by and through its attorneys, Harvey,
Pennington, Cabot, Griffith & Renneisen, Ltd., brings this action by way of Complaint and in
support thereof, avers as follows:
1. Plaintiff is Chase Manhattan Bank USA, N.A., (hereinafter "Plaintiff') a
corporation authorized to do business in the Commonwealth of Pennsylvania, with a place of
business located at 250 West Huron Drive, Cleveland OH, 44113.
2. Defendants, Robert D. DeFlaun and Elaine Meredith DeFlaun, husband and
wife (hereinafter "Defendants") are adult individuals with their principal address located at 48
Rustic Drive Shippensburg, PA, 17257.
3. On August 12, 1999, Defendants purchased a 1994 Redman, Mobile Home,
Vehicle Identification Number 12225430 (the "Mobile Home"), and borrowed the sum of
$42,065.00 from Countryside Village Homes ("the Lender"), to finance the purchase of the
Mobile Home.
4. On August 12, 1999, Defendant executed and delivered to Countryside
Villages Homes, an Installment Sales Contract (the "Contract") evidencing the aforesaid
purchase and Loan. A true and correct copy of the Contract is attached hereto as Exhibit
"A„
5. By written assignment Seller assigned all right, title and interest in and to
said Contract and Loan to Firstmerit Bank N.A., herein with all right, title and interest in an
to the Loan, including the right to commence legal action to recover the balance due and
possession of the Mobile Home.
6. By written assignment Firstmerit Bank N.A. assigned all right, title and
interest in and to said Contract and Loan to Chase Manhattan Bank USA, N.A. , Plaintiff,
herein with all right, title and interest in an to the Loan, including the right to commence
legal action to recover the balance due and possession of the Mobile Home.
7. In order to secure the amount borrowed, Defendants granted a security
interest in the Mobile Home and Plaintiff duly perfected that security interest by causing its
lien to be recorded on the Certificate of Title to the Mobile Home. A true and correct copy
of the Certificate of Title is attached hereto, made a part hereof and marked Exhibit "B".
COUNT I-BREACH OF CONTRACT
8. Plaintiff incorporates the averments of paragraphs 1 through 7, hereof, as if
fully set forth at length.
9. The Loan provided for repayment of the sum borrowed (called "Principal")
with interest at the rate of 12.00% per annum or $13.49 per diem, in consecutive, monthly
installments of $442.78 commencing on September 12, 1999 until the entire amount of
Principal together with accrued interest were paid in full.
10. Defendants breached the terms and conditions of the Loan and became in
default thereof by reason of their failure to make the monthly payment that was due on May
12, 2004 and all subsequent payments due thereafter.
11. Because of the Defendants' default of the repayment terms in the Loan,
Plaintiff has chosen to accelerate all outstanding sums owed under the terms of the Loan in
accordance with the terms therein.
12. Defendants owe Plaintiff the following amounts and demand is hereby made
for payment of same:
(a) Principal $40,507.34
(b) Interest to 10/3/04 $ 2,050.16
(c) Attorneys' Fees $ 900.00
(d) Court Costs (filing & service) $ 155.50
Total $43,613.00
13. Notice pursuant to the provisions of 69 Pa. C.S.A. Section 623(G)(1) was
provided to the Defendant at least thirty (30) days prior to the commencement of this action.
A true and correct copy of the Notice of Intent to Take Action is attached hereto, made a part
hereof and marked Exhibit "C".
14. Despite demand for payment, Defendants have failed to make payment of
the amount due or any portion thereof.
WHEREFORE, Plaintiff demands judgment in its favor and against the Defendants in
the amount of $43,613.00, plus continually accruing interest from and after October 3, 2004
at $13.49 per day or 12.00% per annum, additional attorneys fees, costs of suit and such other
and further relief as this Court deems appropriate.
COUNT II-REPLEVIN
15. Plaintiff incorporates the averments of paragraphs 1 through 14, hereof, as if
fully set forth at length.
16. In accordance with the terms of the Loan, and the provisions of the Uniform
Commercial Code as enacted in Pennsylvania, Plaintiff is entitled to immediate possession of
the Mobile Home and hereby demands same.
17. Despite demand for possession by Plaintiff, Defendant has remained in
possession of the Mobile Home to the exclusion of Plaintiff.
18. Plaintiff believes that unless it is granted immediate possession of the
Mobile Home, the value will continue to decline and Defendant may do damage to it, sell it,
conceal it or remove it from this County, all of which will deprive Plaintiff of a full recovery
of the amount owed and cause Plaintiff immediate and irreparable harm.
19. The Value of the Mobile Home is estimated to be not more than the Total
Debt.
WHEREFORE, Plaintiff demands judgment in its favor and against the Defendant in
replevin for possession of the Mobile Home or its equivalent resale value as of the time of
default, plus reasonable attorneys' fees, costs of suit and such other and further relief as this
Court deems appropriate.

Dear Mr. DeFlaun and Mrs. DeFlaun:
We have been retained by Chase Manhattan Mortgage Corporation ("Plaintiff'), in connection
with that certain Security Agreement ("Agreement"), dated August 12, 1999, which you
signed in favor of Plaintiff. As you are aware, the Agreement covered the 1993 Redman 28 x
60, Vehicle Identification Number 12225430 (the "Mobile Home"), which you purchased,
and pursuant to that and related documents, Plaintiff holds a first priority security interest in
that Mobile Home. Copies of the Agreement and the Certificate of Title reflecting Plaintiff's
lien are enclosed herewith for your reference. You are hereby declared to be in default of
your obligation under the Agreement to timely make all the required monthly installment
payments to Plaintiff, including the payment that came due on May 12, 2004, and all
payments coming due since then (each in the amount of $442.78). As a result, six (6)
monthly payments of $442.78 are now due. The total amount of your missed payments to
date therefore, is $1,771.12. In addition, interest continues to accrue in the amount of
12.00%, or $13.49 per day. Thus, in order to cure the existing default, in other words, to get
caught up on your payments, as of October 18, 2004, you must remit to Plaintiff the total sum
of $1,771.12.
You are hereby advised that after thirty (30) days from the date of this Notice, Plaintiff
intends to accelerate the maturity date of your loan as described in the Agreement, so that the
entire principal balance due thereunder will be immediately due and payable, together with all
accrued and unpaid interest, and any other charges authorized by the Agreement. If you were
to pay this obligation off the total amount due is $42,557.50, plus additional interest accruing
after October 3, 2004 at the contract rate of $13.49 per diem.
You are also advised that after thirty (30) days from the date of this Notice, and so long as
the aforesaid default remains uncured, Plaintiff may proceed to repossess and sell your Mobile
Home to collect all sums due and owing or which may be charged to you under the
Agreement. At any time before title to the Mobile Home is lawfully transferred from you for
the aforesaid default, which will not occur until at least forty-five days from the date of this
Notice, you or any one acting on your behalf, not more than three (3) times in any calendar,
year, may cure your default and prevent sale or other disposition of the Mobile Home and
avoid acceleration. If you do not cure the existing default, your ownership or possession of
the Mobile Home may be terminated by repossession with or without the aid of legal process,
followed by either a public or private sale, subject to the provisions of Article 9 of the
Uniform Commercial Code, as enacted in Pennsylvania at 13 Pa.C.S.A. Section 9101 et sea.
(Purdon's 1998).
To cure any exiting default(s) you must:
(a) Pay or tender in the form of cash, cashier's check or certified check, all sums
which would have been due at the time of payment or tender in the absence of
default, or Plaintiff's acceleration.
(b) Pay or tender any reasonable costs and attorneys fees actually incurred by
Plaintiff, beginning thirty (30) days from the date of this Notice, in connection
with any legal proceedings commenced by Plaintiff, up to the date of payment.
(c) Pay any reasonable late penalty, if provided for in the Agreement;
(d) Pay any reasonable costs which you would have been bound to perform in
the absence of default or the exercise of an acceleration clause, if any.
Please note that any cure of a default in payments due under the Agreement will restore you
to the position as if the default had not occurred. You are also advised that the Agreement
may be prepaid without any penalty or other charge for such prepayment at any time before
the end of the period of the loan.
