PETITION FOR /%PPOINTMENT OF A GUARDIAN
OF THE ESTATE OF A MINOR OVER THE AGE OF 14 YE~
PURSUANT TO 20 PA. C.S. SECTION 5111
TO THE HONORABLE JUDGES OF THE SAID COURT:
The Petition of Bryan J. Kisner and Chelsea S. Kisner
respectfully represents:
1. Petitioners are, Bryan J. Kisner, age 17, born on
November 23, 1987, and Chelsea S. Kisner, age 15, born on October
18, 1989, who reside with their parents at 202 West Green Street,
Shiremanstown, Cumberland County, Pennsylvania.
2. The parents of the minor children are Jeffrey W. and
Susan E. Kisner.
3. There has been no guardian for the estates of the minors.
4. The estate of the minors consists of an interest in the
estate of their grandfather, Wayne E. Kisner, who died on October
8, 2004 .
5. The proposed guardians, Jeffrey W. and Susan E. Kisner,
reside at 202 West Green Street, Shiremanstown, Cumberland County,
Pennsylvania.

6. The proposed guardians are the minors' parents and have
no interest adverse to them. The consent of the proposed guardians
are attached as Exhibit A.
7. The minors have resided with their parents throughout
their lives.
8. The minors each have a 1/5 interest in the estate of
their grandfather, Wayne E. Kisner, valued at approximately
$275,000.00.
9. The estimated annual gross income from the estate will
vary due to the fluctuation of interest rates but is not expected
to exceed $ 2,500.00 for the foreseeable future.
WHEREFORE, petitioners request that this Court appoint Jeffrey
W. and Susan E. Kisner as guardians of each of their estates.

CONSENT OF PROPOSED GUARDIANS
We, Jeffrey W. and Susan E. Kisner, hereby state that:
We hereby consent to act as the guardians of the estates of
our children, Bryan J. Kisner and Chelsea S. Kisner.
We reside at 202 West Green Street, Shiremanstown, cumberland
County, Pennsylvania.
We are citizens of the United States and can speak, read and
write the English language.
We are not the fiduciary or an officer or employee of any
corporate fiduciary of an estate in which the minors have an
interest or the surety or an officer or an employee of the
corporate surety of such a fiduciary.
We have no interest adverse to the minors.
It is not our present intention to apply for an allowance for
the support or education of our children during their minority. We
recognize that we will require court approval before such an
allowance can be authorized.

MOTION TO VACATE GUARDIANSHIP
AND NOW comes Jeffrey W. Kisner, Susan E. Kisner and Bryan J.
Kisner to request that the Decree issued on December 27, 2004 be
vacated in part based on the following:
1. On October 8, 2004 Bryan J. Kisner's grandfather, Wayne
E. Kisner, died.
2. Bryan J. Kisner, born November 23, 1887, was 16 years of
age at the time of his grandfather's death.
3. Bryan J. Kisner was named as a beneficiary in his
grandfather's Will.
4. On December 17, 2004 Jeffrey and Susan Kisner, Bryan's
parents, filed a Petition For Appointment as guardians of Bryan's
estate.
5. Bryan's sister, Chelsea S. Kisner, born October 18, 1989,
was jointed in her parent's Petition.

6. On December 27, 2004 this Honorable Court issued a Decree
appointing Jeffrey W. and Susan E. Kisner as guardians of the
estates of Bryan J. Kisner and Chelsea S. Kisner. A copy of the
Decree is attached as Exhibit A.
7. Wayne E. Kisner's Estate is ready for final distribution
and closing.
8. Bryan J. Kisner is now 18 years of age.
9. Bryan J. Kisner has no mental or physical impairment
requiring the continuation of the appointment of a guardian.
WHEREFORE, it is requested that this Court's December 27, 2004
Decree be amended so as to vacate the appointment of Jeffrey W. and
Susan E. Kisner as the guardians of the estate of Bryan J. Kisner.

2006, upon consideration of the Motion

Jeffrey W. Kisner and Susan E. Kisner as guardian of the estate of
Bryan J.'Kisner, they remain the guardian of the estate of Chelsea
