Tiley, Esquire, and files this Petition to Open Safe Deposit Box of which the following is a statement: cs w rn 1. The Petitioner is Barry Lee Dissinger, an adult individuai;ot�7305 c- � o M r n — cn x, Niblick Court, Dillsburg, Pennsylvania 17019. ?-' � cy U, = tv cr U O D 2. Decedent, Beverly M. Dissinger, died on May 30, 2013 ceitife�t =" copy of her death certificate is attached hereto as Exhibit "A" and is inco'rpora ej to "n herein by reference thereto. 1 At the time of her death, Decedent was a resident of 305 Niblick Court, Dillsburg, Pennsylvania 17019. Decedent and Petitioner resided together. 4. Petitioner is the son of Decedent. 5. Decedent has another son, Richard F. Dissinger, 11, who is the beneficiary of The Richard F. Dissinger, 11 Trust" established by his parents, Richard F. Dissinger and Beverly M. Dissinger, by Declaration of Trust dated July 14, 2000. The said Trust is a special needs trust for the benefit of Richard F. Itr Re: Estate of Beverly A Dissinger,Deceased Petition to Open Safe Deposit Box 1 Dissinger. Barry Lee Dissinger is the contingent (after his parents) trustee of the Trust. 6. Decedent was the widow of Richard F. Dissinger, who died on December 10, 2001. 7. On February 18, 2002 Decedent executed a Last Will and Testament. (the "Will") A copy of the Will, from the files of the undersigned legal counsel, is attached hereto as Exhibit"B" and is incorporated herein by reference thereto. 8. The Will names your Petitioner, Barry Lee Dissinger, as Executor. 9. The Petitioner has been unable to locate the original of the Will among the papers of the Decedent. However, the Petitioner has found a list that the Decedent kept of papers in her safe deposit box. That list identifies the Will. 10. Decedent maintained a safe deposit box at M&T Bank, 4 North U.B. Highway, No., 15, Dillsburg, Pennsylvania. The box is number 171 and is registered in the name of the Decedent alone. 11. M&T Bank records indicate that the safe deposit box has not been accessed for seven years. 12. The Petitioner has not been able to locate the key to the safe deposit box. 11 Pennsylvania law provides for the entry of a safe deposit box to locate a will: (e) Nothing in this part shall prohibit a financial institution from permitting entry into a safe deposit box of a decedent for the sole purpose of removing the decedent's will and evidence of ownership of the burial lot In Re: Estate of Beverly M.Dissinger,Deceased Petition to Open Safe Deposit Box 2 in which the decedent is to be interred. An employe of the financial institution must be present at the opening of the box and make or cause to be made a record of the documents removed from the safe deposit box during the entry and attest the record to be correct and complete under penalty of perjury. 72 P.S. §9192(e) 14. If a safe deposit box is entered pursuant to 72 P.S. §9192(e) the contents of the box, other than a will or evidence of ownership of a burial lot, must be left in the box until the same is later inventoried by a personal representative as authorized by statute. 15. M&T Bank would permit Petitioner to access the safe deposit box to remove a will if Petitioner had the key. Because Petitioner does not have the key M&T Bank requires a Court Order in order to allow the safe deposit box to be drilled open and searched. 16. Because the safe deposit box must be drilled open, its contents, other than a will or evidence of ownership of a burial lot, cannot be returned to it for safe keeping. 17. Pennsylvania law provides that the Court may order the entry of a safe deposit box and the removal of its contents, to wit: (c) The court for cause shown may order that a designated person or persons be permitted to enter a safe deposit box of a decedent and remove the contents described in the order, under supervision as the court may direct. The order may also require that a record be made of the contents of the box. 72 P.S. §9192(c) 18. The undersigned counsel for the Petitioner is willing to hold the contents of the box until such time as the Petitioner can be appointed the personal representative of the Decedent. At least seven days prior to the entry of a safe deposit box, notice is to be given to the Pennsylvania Department of Revenue by return receipt U.S. Mail. 72 P.S. §9193 WHEREFORE, your Petitioner prays Your Honorable Court for an Order: (i) Authorizing the opening of the safe deposit box of the Decedent, Beverly M. Dissinger, located at M&T Bank, 4 North U.S. Highway, No. 15, Dillsburg, PA 17019, in the presence of a bank officer, Barry M. Dissinger, and Stephen D. Tiley, Esquire, and that the contents of the said box be inventoried, removed, and held by the said Stephen D. Tiley, Esquire, until such time as Barry M. Dissinger is appointed personal representative of the Decedent, or further Order of Court, except that any Will may be filed with a Petition for Letters Testamentary; (ii) Authorizing and directing M&T Bank to have the safe deposit box drilled open if the Decedent's key cannot be located; (iii) Directing that prior notice of the safe deposit box opening be given to the Pennsylvania Department of Revenue as required by law; and (iv) Directing that the contents of the safe deposit box be inventoried and reported to the Pennsylvania Department of Revenue. I direct my hereinafter named Executor to pay all of my just debts and funeral expenses as soon after my death as may be found convenient to do so. I direct that all inheritance,transfer,succession,estate and death taxes which may be payable on account of my death shall be paid from the residue of my estate regardless of whether the assets upon which such taxes are based are included in my probate estate. 2. All of the rest, residue and remainder of my estate, real, personal and mixed, and wheresoever the same may be situate,I give,devise and bequeath as follows: One-half(1/2)to my son,Barry Lee Dissinger,his heirs and assigns,provided he shall survive me by a period of ninety(90)days,but should he fail to so survive me then to such of his legitimate issue as shall survive me by a period of ninety (90)days,their heirs and assigns,per stirpes. At the present time my son,Barry Lee Dissinger has never been married and is not the father of any child or children. The meaning of`legitimate issue" as used in this Last Will and Testament shall be limited to a child or children born to a female descendant of Testator regardless of whether the mother is married to the father of such child or children, and shall be limited to a child or children bom to a male descendant of Testator where the father of such child or children is married to the mother either before or after the birth of the child or children. In any case, the meaning of"child"or"children"or"legitimate issue"as used in this Will SHALL NOT include any adopted child or children. The other one-half(1/2) I give, devise and bequeath to my son Barry Lee Dissinger, in Trust,for the benefit of my son,Richard F.Dissinger,D. Said trust being a Declaration of Trust entered into by my late husband and me dated July 14, and which Trust is known as "The Richard F. Dissinger,H Trust," but should my son, Richard F. Dissinger, H fail to survive me then the share he would have received shall go to my son,Barry Lee Dissinger. 1 All of the rest, residue and remainder of my estate, real, personal and mixed, and wheresoever the same may be situate,including any lapsed devise or bequest,I give,devise and bequeath to my son,Barry Lee Dissinger,his heirs and assigns,provided he shall survive me by a period of ninety (90)days,but should he fail to so survive me,then to such of his legitimate issue as shall so survive me,their heirs and assigns,per stirpes,and if there be no such legitimate issue then to the my nieces, who are Diane Leeper,of 4929 Lancaster Street, Harrisburg, PA. 17111, and Suzanne Marroquin of 725 South Front Street, Steelton, PA 17113, provided each shall survive me by a period of ninety (90)days but should either of them fail to so survive me then the share which such deceased niece would have received shall pass to such of her legitimate issue as shall survive me by a period of ninety(90) days,their heirs and assigns,per stirpes. 4. If my son, RICHARD F. DISSINGER, II survives me, in such event I nominate, constitute and appoint my son, BARRY LEE DISSINGER as guardian of his person and guardian of his estate. 5. 1 nominate,constitute and appoint my son,Barry Lee Dissinger,as Executor,of this my Last Will and Testament,and I further direct that he shall not be required to post any bond to secure the faithful performance of his duties in the Commonwealth of Pennsylvania or in any other jurisdiction.
