V. SCOTT SHIRK, CIVIL ACTION -LAW Defendant COMPLAINT AND NOW, comes State Farm Insurance Companies by and through their attorneys WIX, WNEGER & WEIDNER and avers the following: 1. The Plaintiff is a corporation engaged in the casualty insurance business and duly authorized to do business within the Commonwealth of Pennsylvania having its principal office located in Bloomington Illinois. 2. The Defendant is an adult individual residing at 105 Hocher Hill Road, Apt. 1 Boiling Springs, Cumberland County, Pennsylvania 17007. 3. The facts and occurrences hereinafter related took place on or about June 22, 2003 at the intersection of Route 850 and Route 74 which had four way stop signs in Landisburg, Perry County, Pennsylvania. 4. At the time and place aforesaid, Plaintiff had issued a policy of automobile insurance to Elizabeth Ann Hair. 5. At the time and place aforesaid, Elizabeth Ann Hair was the owner and operator of a 1996 Ford Windstar which then and there lawfully proceeded through the intersection of Routes 850 and 74 after coming to a stop. 6. At time and place aforesaid, Defendant was owner and operator of a 2000 Chevrolet Silverado Truck which then and there ran the stop sign at the intersection of Routes 850 and 74 and entered the intersection striking the Hair vehicle and pushing it into a third vehicle lawfully stopped at a stop sign in the intersection. 7. Defendant was negligent in that he: (a) Failed to stop at a stop sign (b) Failed to maintain control over his vehicle; (c) Failed to operate his vehicle at a safe speed (d) Failed to yield the right-of-way; (e) Failed to keep a proper lookout for other vehicles; (f) Failed to have his vehicle insured as required by Pennsylvania's Motor Vehicle Financial Responsibility Law; (g) Was otherwise careless and negligent. 8. Solely as a result of Defendant's negligence Plaintiff was required to pay Elizabeth Hair FOUR THOUSAND NINE HUNDRED FORTY-EIGHT and 88/100 ($4,948.88) DOLLARS for the total loss of her vehicle. 9. Solely as a result of Defendant's negligence Plaintiff was required to pay Elizabeth Hair TWENTY FIVE THOUSAND and 00/100 ($25,000) DOLLARS in uninsured motorist coverage for personal injuries sustained in the accident to herself, her husband and her four children. WHEREFORE, Plaintiff demands judgment against the Defendant in the amount of TWENTY NINE THOUSAND NINE HUNDRED FORTY-EIGHT and 88/100 ($29,948.88) DOLLARS, plus interest and costs of suit.
