NO. 2004 - CIVIL TERM DAVID E. DICK, CIVIL ACTION-LAW Defendant IN DIVORCE DIVORCE COMPLAINT 1. Plaintiff is Kitty A. Dick, an adult individual who currently resides at 3149 Spring Road, Carlisle, Cumberland County, Pennsylvania. 2. Defendant is David E. Dick, an adult individual who currently resides at 814 Hamilton Street, Carlisle, Cumberland County, Pennsylvania. 3. Plaintiff and Defendant have been bona fide residents in the Commonwealth of Pennsylvania for at least six months immediately previous to the filing of this Complaint. 4. The Plaintiff and Defendant were married on August 3, 1976 in Cumberland County, Pennsylvania. COUNT I - DIVORCE UNDER SECTIONS 3301(c) AND 3301(d) OF THE DIVORCE CODE 5. Plaintiff hereby incorporates by reference paragraphs 1 through 4 above. 6. There have been no prior actions of divorce or for annulment between the parties. 7. The marriage is irretrievably broken. 8. The Plaintiff has been advised of the availability of counseling and that she may have the right to request that the court require the parties to participate in Counseling. 9. Plaintiff requests the court to enter a decree of divorce. WHEREFORE, the Plaintiff requests the court to enter a decree of divorce in favor of the Plaintiff and against the Defendant. DIVORCE - ADULTRY 9. The allegations in paragraphs one through eight, inclusive are made a part hereof and incorporated herein by reference. 10. The Defendant has engaged in adulterous conduct during the marriage, entitling wife to a divorce on the grounds of adultry. WHEREFORE, Plaintiff prays your Honorable Court to enter a decree in divorce COUNT II -EQUITABLE DISTRIBUTION 11. Plaintiff hereby incorporates by reference paragraphs 1 through 10 above. 12. The parties have acquired real estate, personal property, including automobiles, bank accounts and other items of miscellaneous property during the course of their marriage, some of which is marital property. WHEREFORE, Plaintiff respectfully requests this Honorable Court to enter a decree which effects an equitable distribution of marital property. COUNT III - ALIMONY 13. Plaintiff hereby incorporates by reference paragraphs 1 through 12 above. 14. Plaintiff lacks sufficient property to provide for her reasonable needs in accordance with the standard of living of the parties established during the marriage. 15. Plaintiff is unable to support herself in accordance with the standard of living of the parties established during the marriage through appropriate employment. 16. The Defendant is employed and enjoys a substantial income from which he is able to contribute to the support and maintenance of Plaintiff and to pay her alimony in accordance with the Divorce Code of Pennsylvania. WHEREFORE, Plaintiff requests this Honorable Court to enter an Order directing Husband to pay Wife alimony. COUNT IV - ALIMONY PENDENTE LITE 17. Plaintiff hereby incorporates by reference paragraphs 1 through 16 above. 18. Plaintiff is without sufficient income to support and maintain herself during the pendency of this action. 19. Defendant enjoys a substantial income and is well able to contribute to the support and maintenance of Plaintiff during the course of this action. WHEREFORE, Plaintiff requests this Honorable Court to order the Defendant to pay Wife alimony pendente lite during the pendency of this litigation. COUNT V - COUNSEL FEES AND EXPENSES 20. Plaintiff hereby incorporates by reference paragraphs 1 through 19 above. 21. Plaintiff is without sufficient funds to retain counsel to represent her in this matter. 22. Without competent counsel, Plaintiff cannot adequately prosecute her claims against Defendant and cannot adequately litigate her rights in this matter. 23. Defendant enjoys a substantial income and is well able to bear the expense of Plaintiffs attorney and the expenses of this litigation. WHEREFORE, Plaintiff requests your Honorable Court to enter an award of alimony pendente lite and to further award such additional counsel fees, costs and expenses as are deemed appropriate. DICK, Defendant IN DIVORCE THE MASTER: Today is Monday, September 29, 2008. This is the date set for a conference with counsel and the parties. Present in the hearing room are the Plaintiff, Kitty A. Dick, and her counsel Michael A. Scherer, and the Defendant, David E. Dick, and his counsel P. Richard Wagner. This action was commenced by the filing of a complaint in divorce on December 21, 2004, raising grounds for divorce of irretrievable breakdown of the marriage and adultery. With respect to the grounds for divorce, the parties are going to sign affidavits of consent and waivers of notice of intention to request entry of divorce decree today so that the divorce can be concluded under Section 3301(c) of the Domestic Relations Code. The affidavits and waivers will be filed with the Prothonotary by the Master's office. The complaint also raised economic claims of equitable distribution, alimony, alimony pendente lite, and counsel fees and expenses. The Master has been advised that after 1 discussion with the parties and counsel that the parties are willing to accept an agreement which is going to be placed on the record in the presence of the parties. The agreement as stated on the record will be considered the substantive agreement of the parties, not subject to any changes or modifications except for correction of typographical errors which may be made during the transcription. Consequently, when the parties leave the hearing room today they are bound by the terms of the agreement as stated on the record even though there is no subsequent signing of the agreement affirming the terms of settlement. The parties and counsel are going to return to the Master's office today and tomorrow morning to review the agreement and sign the agreement affirming the terms of settlement. Upon receipt by the Master of a completed agreement, the Master will prepare an order vacating his appointment and counsel can then file a praecipe transmitting the record to the Court requesting a final decree in divorce. The parties were married on August 3, 1976, and separated October 9, 2004. They are the natural parents of one child who is emancipated. Mr. Wagner. MR. WAGNER: 1. Husband and wife do hereby covenant, promise and agree 2 that the marital home situate at 3149 Spring Road, Carlisle, Cumberland County, Pennsylvania, should become the sole and separate property of wife. Husband agrees to execute a deed transferring his interest in said property. Wife agrees to be solely responsible for payment of the mortgage, taxes, and insurance on said property and agrees to indemnify and save harmless husband on account of same. From this point forward, wife shall be solely responsible for the payment of the mortgage, taxes, and insurance and shall within two years from the date of this agreement refinance or otherwise remove husband's name from the mortgage. Husband agrees to cooperate with wife to effectuate said removal and/or refinancing. Husband agrees to sign a deed effectuating the aforementioned transfer within thirty (30) days from today. 2. Wife has a retirement and/or pension with GS Electric in the form of a 401(k) and husband has a retirement plan through North Middleton Township. Each party agrees that the pension of the other shall remain the property of the other and each party agrees to waive, relinquish and discharge any and all right, title, and interest in the retirement, 401(k) and/or pension of the other. Each party agrees to execute whatever documents are necessary to effectuate the relinquishment of his or her claim to the retirement of the other. 3. The parties agree that they have certain personal property that shall be divided as follows: A 1995 Yukon shall become the sole and separate property of husband; A 1997 Montana shall become the sole and separate property of wife. Each party agrees to execute a title evidencing transfer of that property to the proper person. 4. There are certain items of personal property that husband and wife agree shall be made available to husband within thirty (30) days of the date of this agreement. The personal property shall constitute a lantern fountain statute, tools of husband, a mantel clock, trains in the attic, two tires for the husband's trailer. Husband and wife agree and acknowledge that there is a Sawall that belongs to husband that is in the possession of the parties' daughter and husband agrees to deal with the daughter to 3 obtain that personal property. All personal property except as herein set forth shall remain the sole and separate property of the person currently having possession of the same. Each party agrees to relinquish any claim they may have regarding the personal property in the possession of the other except as aforementioned. 5. Each party agrees that they shall waive from the other alimony, alimony pendente lite and support and counsel fees. 6. Husband and wife agree that wife received a joint tax refund, a Christmas club account, and three paychecks from husband at or around the time of separation. Husband agrees to relinquish any claim he may have for the tax refund, Christmas Club account, and the three paychecks and in return wife agrees to waive any and all arrearages that have accumulated at the support docket in the Court of Common Pleas of Cumberland County, PACES No. 057106980. Both parties agree to execute whatever documents are necessary with the support office to effectuate the relief from the arrearage as well as the discontinuance of the support action. 7. With the exception of the mortgage on the property there is no no marital debt and each party agrees to assume the debt that each has incurred since separation. 8. Except as herein otherwise provided, each party may dispose of his or her property in any way and each party hereby waives and relinquishes any and all rights he or she may now have or hereafter acquire under the present or future laws of any jurisdiction to share in the property or the estate of the other as a result of the marital relationship including without limitation, statutory allowance, widow's allowance, right of intestacy, right to take against the will of the other, and right to act as administrator or executor in the other's estate. Each will at the request of the other execute, acknowledge, and deliver any and all instruments which may be necessary or advisable to carry into effect this mutual waiver and relinquishment of all such interest, rights, and claims. 9. Further each party agrees to execute whatever consents and/or waivers are necessary under Section 3301(c) of the Divorce Code to effectuate a divorce by and from each other. MR. WAGNER: You've been sitting here in this 4 proceeding as I dictated that particular proposed agreement; did you hear it? MR. DICK: Yes. MR. WAGNER: Do you understand each and every element that I stated as the proposed agreement between you and your wife? MR. DICK: All except the end there where it says about the spousal support benefit and stuff like that. MR. WAGNER: You're done. MR. DICK: Okay. MR. WAGNER: You're not collecting anything from her; she is not collecting any from you. MR. DICK: Okay. MR. WAGNER: Do you want this to be the agreement between you and your wife? MR. DICK: Yes. The other thing is, I would like to have my fire trucks. My Franklin Mint fire trucks, that's it. MR. SCHERER: How do you feel about the Franklin Mint fire trucks? MS. DICK: I say they go to the grand kids. MR. DICK: Okay. MR. WAGNER: Further, each party agrees that the Franklin Mint fire truck collection shall go to the parties' grandchildren. 5 Anything else? MR. DICK: That is it. MR. WAGNER: You want this to be the agreement between the parties? MR. DICK: That's the agreement. MR. WAGNER: David, a couple of things I want to cover, coming in here today, you and I had a discussion about certain obligations and responsibilities that didn't get fulfilled? MR. DICK: Yes. MR. WAGNER: And you knew coming in here today that I was probably going to withdraw? MR. DICK: Yes. MR. WAGNER: And you knew coming in here today that we did not have an appraisal done on Kitty's pension? MR. DICK: Yes. MR. WAGNER: And we did not have an appraisal done on your pension? MR. WAGNER: And you understand you have the right to seek appraisals on each of those three items in 6 this marriage? MR. DICK: Yes. MR. WAGNER: Knowing what I just told you, it is still your intent to have this agreement entered between you and your wife ending, literally, everything except the enforcement of the agreement? MR.
