COMPLAINT
This Complaint is filed in response to the Notice of Appeal filed by the Defendant
Richard Gowins.
Notice to pay outstanding rent was given to the Defendants on November 17, 2004.
At the end of the stipulated period they had not paid and the matter went before DJ
Paula Correal on December 13, 04.
The Court entered a judgment for the plaintiff (M H Afghan) in the sum of $1335.13
which was outstanding rent plus Court costs- Within ten days the Defendant was
supposed to have paid this amount and in the same period I was supposed to repair and
correct a number of things in the apartment which the Defendant had cited as reasons for
not paying rent. All the repairs were carried out within the next few days. At the end of
the ten days, he had not fulfilled his obligation according to the Judgment and instead
filed an Appeal.
1 understand that on the 1 i u' day i can file a Notice for possession, the 11 `h day was Dec
24`h, but due to the Holidays, this could not be done, I have now filed a Request for Order
for Possession on Dec 28, 04.
