Pykosh, Esquire, and files the following municipal claim against William L. Gouse, of which currently owns the property located at 381 Criswell Drive, Boiling Springs, Pennsylvania 17007. William L. Gouse is the owner of all that certain lot of ground, including any improvements thereon, being more fully described as follows: ALL THAT CERTAIN undivided one -half interest in two tracts of land with improvements thereon erected, situate in Monroe Township, Cumberland County, Pennsylvania, bounded and described as follows: TRACT NO. 1: BEGINNING at an iron pin at land now or formerly of the P.H. & P.R.R.; thence by land now or formerly of Annie E. Criswell, North 7 '/Z degrees West, 27 perches to the middle of the Yellow Breeches Creek; thence by said creek and by land now or formerly of Reuben Cockley, North 72 degrees West, 30.1 perches; thence by the same, North 84 %z degrees West, 14.3 perches; thence by land now or formerly of Leidich heirs, South 16 '/4 degrees West, 13.1 perches to an iron pin at land now or formerly of the said P.H. & P.R.R.; thence by the said P.H. & P.R.R. lands, North 88 3 /4 degrees East, 39.4 perches; thence by same, South 82 '/4 degrees East, 15.3 perches to the place of BEGINNING. CONTAINING 8 acres and 133 perches. HAVING thereon erected a two -story frame dwelling house, stable and other buildings. LESS, however, the following pieces or parcels of land which John A. Gouse, Jr. and Edith A. Gouse (a/k/a Edith Augusta Gouse), his wife, conveyed and adversed therefrom in and by the following deeds: 1. Deed Book "Y ", Volume 15, Page 224, dated August 21, 1954, to Mary R. Enck for 1.7 acres, more or less. 3. Deed Book `B ", Volume 16, Page 407, dated August 28, 1954, to Walter S. Rasp for 1.2 acres, more or less. 4. Deed Book "L", Volume 17, Page 53, dated October 6, 1956, to Frank M. Gouse and Lucy A. Gouse, his wife. 5. Deed Book "B ", Volume 20, Page 924, dated November 30, 1960, to James R. Gouse, et al. TRACT NO. 2: BEGINNING at a point in the centerline of the Yellow Breeches Creek at line of land formely of John Hock, now or formerly of John A. Gouse (Tract No. 1 above); thence by said centerline, North 84 degrees 30 minutes West, 158 feet along line now or formerly of land of Reuben Cockley, to a point; thence by other land now or formerly of Paul E. Wise and wife, crossing a public road running through this tract and through an iron pipe 15 feet south of the centerline of said road, South 16 degrees 35 minutes West, 315 feet, more or less, to a point on the northern right -of -way line of the Reading Company; thence by the said northern right -of -way line, South 82 degrees 50 minutes East, 158 feet, more or less, to an iron pin on the line of land now or formerly of John A. Gouse (Tract No. 1 above); thence by the latter land, North 16 degrees 30 minutes East, 520 feet to the place of BEGINNING. CONTAINING 1 acre, 141 perches, more or less. BEING THE SAME PREMISES which the First and Final Account and Statement of Proposed Distribution of Lisa M. Minnich, Executrix of the Estate of Edith A. Minnich, having been confirmed by the Court of Common Pleas of Cumberland County, Pennsylvania, Orphans' Court Division, on April 27, 2010, pursuant to 3534 of the Probate, Estates and Fiduciaries Code of 1972, as amended, by Decree Awarding Real Estate dated July 1, 2010, and recorded July 6, 2010, in the Recorder of Deeds Office in and for Cumberland County, Pennsylvania, as Instrument Number 201017975, awarded to William L. Gouse. TAX PARCEL NO. 22-30-2664-017. Monroe Township Municipal Authority hereby files this Municipal Lien for Services and Sewer Rates levied and assessed from through and including. Said Authority services and sewer rates were levied and assessed pursuant to Authority Resolution No. 02 -04, same being known as a Resolution of the Board of Monroe Township Municipality Authority imposing user charges to be collected from the owner of each improved property served or to be served by the Authority's sewer system, in conjunction with all prior relevant Resolutions and Ordinances, including, but not necessarily limited to, Monroe Township Ordinance No. 3 of 1978 and Monroe Township Ordinance No. 99 -6, as amended; and providing for payment and collection of such user charges. Attached hereto and incorporated herein are the statement(s) forwarded by Monroe Township Municipal Authority for sewerage dues treated from April 1, 2013, through June 30, 2013, which services total is in the amount of one thousand one hundred fifty -three and 00 /100 ($1,153.00) dollars, which sum was duly assessed against, and the real property described herein from the date of said billing statements as attached hereto, and for which sum, with interest in the amount of ten (10 %) percent, along with penalties and all costs, including attorneys' fees, a municipal lien is claimed against the above - described real property and premises in accordance with the Act of May 16, 1923, P.L. 207, §7, as amended, 53 P. This account is delinquent. As of the last billing notice, same being dated February 15, 2013, the delinquency is in the amount of $913.00. The purpose of this letter is to give you the following three options regarding your past due account: A. Full Payment of the entire outstanding balance to be made within ten (10) days of the date of this letter; B. Contact the Authority to set up a Payment Agreement of a minimum of $100.00 per month on account of the arrears and required to keep up with all quarterly charges billed thereafter. The Agreement must be finalized within ten (10) days of the date of this letter; C. The lien /sheriffs sale process will immediately commence if there is no communication from the owner to set up and complete either option A or B within ten (10) days of the date of this letter. Option C will result in fling fees, service costs, and attorney's fees. Attorney's fees that are incurred with respect to the collection of this delinquent account will be assessed at the current rate. The imposition of assessment of attorney's fees may be avoided by you making payment in full or executing a Payment Agreement within ten (10) days of date of this letter. I am aware after the last letter mailed to you in January 2013, you were looking for financial assistance with the sewer bill.
