PETITION TO ADMIT TO PROBATE
A PHOTO COPY OF WILL
The petition of Gladys C. Duncan states that:
1. The petitioner is the niece of Mabel I. Gordon who died a resident of
Cumberland County, Pennsylvania, on January 24, 2002.
2. Decedent was a single woman who made her home with her niece, Gladys
C. Duncan, for the past 35 years at 320 West Penn Street, Carlisle, PA, 17013.
3. On October 6, 1994, Decedent executed a will, a copy of which is attached
as Exhibit "A", wherein it named petitioner as executor of her will.
4. The will was prepared by decedent's attorney, Frances H. Del Duca, and
was notarized by Shirley Clevenger as evidenced by a copy from her ledger attached as
Exhibit "B".
5. The will was delivered to the decedent who gave it to petitioner which was
kept in petitioner's desk drawer in her bedroom. See envelope attached as Exhibit "C".
6. On April 14, 1999, decedent executed a Power of Attorney naming her
niece, Gladys C. Duncan, as her Agent, a copy of which is attached as Exhibit "D".
7. On August 2, 1999, decedent conveyed her residence at 320 West Penn
Street to herself and her niece as joint tenants with right of survivorship, a copy of which
is attached as Exhibit "E".
8. Petitioner is unable to find the will which is missing from the envelope.
9. Decedent wanted to benefit petitioner in every way as petitioner has
certain disabilities.
WHEREFORE, petitioner respectfully requests that the photocopy of the will
dated October 6, 1994 be admitted to probate.

Pennsylvania, declare this to be my Last Will and revoke any
Wills previously made by me.
I. I direct that any and all inheritance, estate and
transfer taxes imposed upon my estate passing under my Will
or otherwise, shall be paid out of the principal of my
residuary estate.
II. I devise and bequeath my estate of whatever nature
or wherever situated to my niece, GLADYS C. DUNCAN, if she
survives me by sixty (60) days.
III. I appoint my niece, GLADYS C. DUNCAN, to be
executor of this my Last Will.
IV. I direct that my personal representative need not
file bond in this or any other jurisdiction.

GENERAL POWER OF ATTORNEY
KNOW ALL BY THESE PRESENTS, that I, MABEL I. GORDON, do
make, constitute and appoint GLADYS C. DUNCAN, my true and
lawful attorney for me and in my name and to my use.
1. To ask, demand, sue for and receive all sums of
money and securities now due or which may hereafter become
due and payable to me in any manner whatsoever, and upon
receipt of same to sign, seal, execute and deliver all
necessary acquittances and discharges therefor.
2. To deposit any moneys which may come into her hands

her own name and any of such money or any other money to
which I am entitled which now is or shall be so deposited,
to withdraw as she shall think fit; to sign mutual savings
bank and federal savings and loan association withdrawal

with any bills of exchange, checks, promissory notes or
other commercial or mercantile instruments; to borrow any

3. To have access to any and all safe deposit boxes
registered in my name, and to remove any and all contents
thereof.
4. To manage, let and demise any real estate now
belonging or which may hereafter belong to me, to enter and
re-enter upon the same, taking possession thereof from time
to time as shall be desirable, to give notices to quit and
the like, to collect all rents due and to become due, with
power to institute actions at law in my name and to conduct
all manner of proceedings at law, distraint or otherwise,
which to her shall seem proper and necessary.
5. To grant, bargain and sell, assign, or transfer at
public or private sale, any real estate, lands, tenements or
hereditaments of which I may have, or hereafter acquire any
interest, and any tangible personal property, for any price
or consideration, with or without any reservations,
restrictions or conditions, to receive the purchase money
and to sign, seal, execute, acknowledge and deliver all
deeds, conveyances, assignments, bills of sale, or other
instruments necessary to effect the same, to make and

to sell and assign the same and to collect the proceeds of

9. To execute and to file Federal, State and local
income tax or other returns. To file internal revenue forms
1 through 10,000 for income, refunds, requests for
extensions of time, any and all other tax related documents
including any power of attorney form required by-Internal
Revenue Service with respect to tax years 1990 through 2040.
10. To authorize my admission to a medical, nursing,
residential or similar facility and to enter into agreements
for my care.
11. To authorize medical and surgical procedures.
12. To make gifts limited as to donees to my spouse,
children, any recognized charities (IRS 501(c) (3)
organizations) and such gifts shall be limited in amount to
an aggregate value not in excess of, and shall be made in
such manner as to qualify in their entirety for, my annual
exclusion from the federal gift tax permitted under Section
2503(b) of the Internal Revenue Code.

A. Gordon died June 2, 1986, thus vesting sole ownership in Mabel I. Gordon,

The tax rate imposed on the net value of transfers from a deceased child twenty-one years of age or younger at death to or for the use of a natural parent, an

The tax rate imposed on the net value of transfers to or for the use of the decedent's lineal beneficiaries is 4.5%, except as noted in 72 P.S. §9116(1.2) [72

The tax rate imposed on the net value of transfers to or for the use of the decedent's siblings is 12% [72 P.S. §9116(a)(1.3)]. A sibling is defined, under
Section 9102, as an individual who has at least one parent in common with the decedent, whether by blood or adoption.
For dates of death on or after July 1, 1994 and before January 1, 1995, the tax rate imposed on the net value of transfers to or for the use of the surviving
