C.S.A. 5513 1) Your Petitioner is Robert L. O'Brien, Esquire, Solicitor for the Cumberland/Perry County Mental Health/Mental Retardation Office. 2) Respondent is Richard Humes, an incapacitated person, currently receiving care at Holy Spirit Hospital, Camp Hill, PA., 17011. Respondent is an adult individual being presently 71 years of age with a birth date of April 24, 1931. The Respondent does not have a Guardian. 3) The proposed guardian is Gregory D. Knox of the Cumberland/Perry MHMR office. Attached is a social history relating to Mr. Humes. Prior to his admission to Holy Spirit for medical treatment, Mr. Humes had been residing in a group home. Mr. Humes has been in institutional care for most of his life due to his severe mental retardation. The hospital feels that he should be discharged to a nursing home and an assessment supports the treating physician's recommendation. Mr. Knox requests that he be appointed a temporary guardian to arrange for Mr. Humes admission to a nursing home care facility upon his discharge from the hospital. 4) The proposed Guardian has no interest adverse to that of Mr. Humes. 5) Mr. Humes has no known next of kin. WHEREFORE, Petitioner, Robert L. O'Brien, respectfully requests that the Court order that Respondent Richard Humes be adjudged an incapacitated person and Gregory D. Since 1987 Mr. Humes has resided in a group home operated by Lntpact Systems, Inc. under contract with the Cumberland/Perry MH/MR Pmgrmn. He previously was institutionalized at Pennhurst (1947-1960) and White Haven Center (1960-1982) and Laurdton Center (1982-1987). Current Status: Mr. Humes' medical condition has been deteriorating over the past 7 months due to Chronic Obstructive Pulmonary Disease. He has been hospitalized eight times fbr thi,~ medical problem since September 2001. He is currently on the Inpatient Unit at Holy Spirit Hospital. His attending physician is recommending nursing home placemel~t. This placement should be made as soon as possible after acceptance to a nursing thcility has been confirmed. He was transferred to White Haven State School and Hospital oa April 28, 1950, Behavior and I~Cerpersonal Relationships Richard is basically a quiet and withdrawn individual. He is generally charac:e:r£zed aa a "loner" and frequently occupies his time by sitting in a corner alone. He had in the past displayed some sexual misconduct, but has not recently. Self-Care Richard ia ambulatory and toilet trained. He is capable of caring for all phases of self- care with iuidance and supervision, He can ~eed hi~elf. He was evaluated by our Speech and Hearln$ Department on August 1, 1967. At that time, Richard vas termed: "language, ~oor; adequate speech skills." As was previously s:ated, Richard is basically a loner. He does participate in some activities if encoura8ed. He especially enjoys colorin~. Family Situation There is no in:ormation available on the whereabouts of any of Richard's family.
