MUNICIPAL LIEN FOR SEWER /REFUSE RATES
NOW COMES the Borough of Mechanicsburg Cumberland County,
Pennsylvania, by its attorney Lisa Marie Coyne, Esquire, and files the within claim
for charges assessed with respect to sewer and /or refuse rates against above
named owner or owners and against the hereinafter described real estate as
follows:
STATEMENT OF CLAIM
1. This claim is filed by the Borough of. Mechanicsburg, a borough organized
and existing in accordance with the laws of the Commonwealth of
Pennsylvania.
2. The owner or reputed owner of the property, or party or parties
responsible or liable, for which this claim is filed is the Defendant(s).
3. The authority under which the sewer and /or refuse rates were changed
and assessed is the Act of July 18, 1935, P.L. 1286, Section 1, 53 P.S. § 2231,
as amended.
4. Plaintiff has made demands for payment for services; however, Gib
Defendant(s) have not made payments for the services provided.
5. The authority under which this claim is filed is the Act of May 16, 1923
P.L. 207, Section 9, et seg ., 53P.S. §7143, as amended.
6. A description of the property against which this claim is filed is:

TAX PARCEL NUMBER 17 -24 -0789 -304
7. This claim has not been the subject of any previous claim and judgment
in the Court of Common Pleas of Cumberland County for sewer and /or
refuse charges.
8. The total amount of the charges for which this claim is filed is
seven hundred sixteen dollars and fifty cents ($716.50), plus costs and
reasonable attorney's fees.
9. The time period for which these charges /are filed is July 1, 2012 to June 30,
2013 on Sewer and Refuse Account 6673 -0.
WHEREFORE, Claimant requests that a Municipal Lien be entered in its
favor and against the Defendant in the amount of seven hundred sixteen dollars
and fifty cents ($716.50), plus cost and reasonable attorney's fees.

along said dividing line, South 73 degrees 13 minutes west one hundred ten (110.00) feet to a point;
thence North 16 degrees 47 minutes West eight-five (85.00) feet to a point; thence North 73
degrees13 minutes East one hundred ten (110.00) feet to a point on the western line of Darla Road;
thence along the western line of Darla Road, South 16 degrees 47 minutes East eight -five (85.00)
feet to a point on the western line of Darla Road, said point being at the dividing line between Lots
Nos. 199 and 142 -A on the hereinafter mentioned plan of lots, the place of BEGINNING.
BEING Lot No. 199 on Final Plan No. 10, Plot "B" of Heritage Acres, said plan being recorded in the
Cumberland County Recorder of Deeds Office in Plan Book 29, page 120.
BEING THE SAME PREMISES which William F. Rugg and Edeltraud R. Rugg by Deed dated
January 24, 2006, and recorded January 27, 2006 in the Cumberland County Recorder of Deeds
Office in Record Book. 272 Page 4640, granted and.conveyed unto.William F. Rugg and Edeltraud
R. Rugg, Trustees of the Rugg Family Trust dated January 24, 2006, grantors herein.
UNDER AND SUBJECT, NEVERTHELESS, to all easements, restrictions, encumbrances
and other matters of record or that which a physical inspection or survey of the premises would
reveal.
TOGETHER with all and singular the buildings, improvements, ways, woods, waters,
watercourses, rights, liberties, privileges, hereditaments and appurtenances to the same belonging
or in anywise appertaining; and the reversion and reversions, remainder and remainders, rents,
issues and profits thereof, and of every part and parcel thereof; AND ALSO all the estate, right, title,
interest, use, possession, property, claim and demand whatsoever of the Grantors both in law and
in equity, of, in and to the premises herein described and every part and parcel thereof with the
appurtenances. TO HAVE AND TO HOLD all and singular the premises herein described together
with the hereditaments and appurtenances unto the Grantee(s) and to the Grantees proper use
and benefit forever.
AND the Grantors covenant that, except as may be herein set forth, they do and will forever
specially warrant and defend the lands and premises, hereditaments and appurtenances hereby
conveyed, against the Grantors and all other persons lawfully claiming the same or to claim the
same or any part thereof, by, from or under it, them or any of them.
In all references herein to any parties, persons, entities or corporations, the use of any
particular gender or plural or singular number is intended to include the appropriate gender or
number as the text of the within instrument may require.

Wherever in this instrument any party shall be designated or referred to by name or general
