Defendant Matthew Hearn , upon information and belief, is an adult individual with a last known address at the above-stated address. 2. Jurisdiction and venue are proper in this matter. FACTS 3. First National Bank of Omaha is a corporation engaged in the business of providing consumer credit. 4. On or about November 22, 2006, Defendant entered into a credit card application with Plaintiff for a credit card. 5. Plaintiff provided consumer credit to the Defendant. 6. At the time the credit card was issued, Defendant was subject to a written card member agreement(the "Agreement"). 7. In accordance with the terms and conditions of the Agreement, Defendant agreed to pay Plaintiff for the goods and services purchased. 8. Defendant's credit card is subject to the terms and conditions of that Agreement, and a copy of the Agreement had been mailed to and accepted by Defendant. 9. A copy of the application entered into and submitted by the Defendant is not available due to the age of the account. 10. Defendant's course of conduct clearly establishes her acceptance of the terms and conditions of the credit card agreement. 11. Defendant has failed and/or refused to make monthly payments on the account balance as required by the Agreement. 12. Pursuant to the Agreement, Defendant is in default by failing and/or refusing to make the monthly payments when due. 13. Defendant is in default under the terms of the Agreement by virtue of his failure and/or refusal to tender timely payments when due and/or upon demand, and have become liable to Plaintiff in the amount of$5,076.79 A true and correct copy of the Final Billing Statement is attached hereto and incorporated herein as Exhibit"A". 14. All of the terms and credits under the Agreement remain unchanged and in full force and effect. See attached Card Member Agreement attached as Exhibit`B" 15. Plaintiff demanded that Defendant comply with the terms and conditions of the Credit Application. FIRST (1ST) COUNT (Book Account or Account Stated) (First National Bank of Omaha vs. Matthew Hearn) 16. Plaintiff hereby incorporates by reference all of the previous paragraphs as though the same were herein set forth at length. 17. Defendant requested a credit card with Plaintiff, and Plaintiff provided credit to Defendant. 18. Defendant used the Visa Signature credit card issued by Plaintiff to purchase goods and services in the amount of$5,076.79. See Exhibit"A." 19. Defendant's account was charged off by Plaintiff on or about September 30, 2013 20. A true and correct copy of the Book Account is attached hereto as Exhibit"A". WHEREFORE, Plaintiff, First National Bank of Omaha demands judgment against Defendant, Matthew Hearn on this count of the Amended Complaint for$5,076.79 together with costs of suit and all such other and further relief as this Court deems appropriate. SECOND (2ND) COUNT (Unjust Enrichment) (First National Bank of Omaha vs. Matthew Hearn) 21. Plaintiff hereby incorporates by reference all of the previous paragraphs as though the same were herein set forth at length. 22. As requested by Defendant, Defendant was provided with credit from Plaintiff to purchase goods and services. 23. Defendant has been unjustly enriched by her use, acceptance, and retention of goods purchased by using the account without making payment to Plaintiff. 24. Defendant, by her use, acceptance, and retention of the goods purchased using the credit card, without making the payments when due, was unjustly enriched to the detriment of the Bank. 25. Defendant received the benefits from the issuance of the credit in the amount of $5,076.79, and Plaintiff is entitled to the reasonable value of the goods and services. 26. Plaintiff is entitled to payment pursuant to an implied contract between the parties to prevent Defendant from being unjustly enriched due to the performance of Plaintiff. 27. Where unjust enrichment is found, the law implies a contract, which requires the defendant to pay to the plaintiff the value of the benefit conferred. Schenck v. K.E. David, Ltd., 446 Pa.Super. 94, 666 A.2d 327 (1995). 28. The elements necessary to prove unjust enrichment are: (A) benefits conferred on defendant by plaintiff; (B) appreciation of such benefits by defendant; and (C) acceptance and retention of such benefits under such circumstances that it would be inequitable for defendant to retain the benefit without payment of value. (citations omitted). 29. Despite repeatedly requesting payment from the Defendant, Defendant has willfully failed and/or refused to pay. 30. As a result of Defendant's failure and/or refusal to comply with the Credit Application, Defendant has been unjustly enriched. 31. As a result of Defendant's conduct, Plaintiff has been damaged in the amount of$5,076.79.
