WASHINGTON and ROXANNE WASHINGTON CIVIL DIVISION - LAW Defendants COMPLAINT The Plaintiff, FIRST NATIONAL BANK OF OMAHA, by its attorneys, KNUPP, KODAK & IMBLUM, P.c., brings this action of Assumpsit against the Defendants to recover the sum of TWENTY-FOUR THOUSAND, NINE HUNDRED NINETY -ONE DOLLARS AND TWENTY-TWO CENTS ($24,991.22), along with interest thereon from June 26,2004, upon a cause of action of which the following is a statement: 1. The Plaintiff, FIRST NATIONAL BANK OF OMAHA, is a corporation organized and existing under the laws of the state of Nebraska, having mailing address of Post Office Box 2951, Omaha, Nebraska, 68103-2951. 2. The Defendants, JAMES R. WASHINGTON and ROXANNE W ASIllNGTON, are adult individuals residing at 211 Faith Circle, Carlisle, Cumberland County, Pennsylvania 17013. COUNT I -FIRST NATIONAL BANK OF OMAHA vs. JAMES R. WASHINGTON AND ROXANNE WASHINGTON 3. Paragraphs 1 and 2 are incorporated herein as if fully and at length set forth. 4. Defendants did apply for a Visa Account with Plaintiff. Subsequent thereto, Plaintiff issued same to account number 44184091 9831 6573. Upon receipt and use of said card, Defendants did agree to abide by Plaintiffs terms and F:\USER\ST ACY\CCP COMPLAINTS\ WORK\OMAHA3099I I&U.wpd:29Nov04 2 conditions for the card as set forth on Plaintiffs Cardmember Agreement, attached hereto, marked Exhibit "A" and made a part hereof. 5. Defendants did, at various times, in various places, and for various amounts, avail themselves of using the card for credit, thereby creating a balance due and owing in the amount of Twelve Thousand, Seventy-Six Dollars and Fifty- Nine Cents ($12,076.59), as set forth on Plaintiffs Invoice attached hereto, marked as Exhibit "B" and made a part hereof. 6. The prices charged for said goods, wares, merchandise, services, and/or labor which Defendants charged on said card were just and reasonable, were the legal and market prices therefor and were the prices which the Defendants promised and agreed to pay. 7. Plaintiff frequently demanded payment from Defendants of said amount due and owing as aforesaid, but Defendants refused and neglected and still refuse and neglect to pay said amount of any part thereof. WHEREFORE, Plaintiff brings this suit to recover from Defendants the sum of Twelve Thousand, Seventy-Six Dollars and Fifty-Nine Cents ($12,076.59) along with interest thereon from June 26, 2004. COUNT I -FIRST NATIONAL BANK OF OMAHA vs. JAMES R. WASHINGTON AND ROXANNE WASHINGTON 8. Plaintiff incorporates Paragraphs I through 7 inclusive as iffully and at length set forth herein. Subsequent thereto, Plaintiff issued same to account number 441802523211 1216. Upon receipt and use of said card, Defendants did agree to abide by Plaintiffs terms and conditions for the card as set forth on Plaintiff's Cardmember Agreement, attached hereto, marked Exhibit "C" and made a part hereof. 10. Defendants did, at various times, in various places, and for various amounts, avail themselves of using the card for credit, thereby creating a balance due and owing in the amount of Twelve Thousand, Nine Hundred Fourteen Dollars and Sixty-Three Cents ($12,914.63), as set forth on Plaintiff's Invoice attached hereto, marked as Exhibit "D" and made a part hereof. 11. The prices charged for said goods, wares, merchandise, services, and/or labor which Defendants charged on said card were just and reasonable, were the legal and market prices therefor and were the prices which the Defendants promised and agreed to pay. 12.
