COMPLAINT
The Plaintiff, PENNSYLVANIA CENTRAL FEDERAL CREDIT UNION, by its attorneys, KNUPP, KODAK &
IMBLUM, P.C., brings this action against the Defendants to recover possession of 2000 Toyota Tacoma, 1.0. Number
4T A WN72N5YZ595315 and in furtherance thereof, sets forth the following:
I. The Plaintiff, PENNSYLVANIA CENTRAL FEDERAL CREDIT UNION, Successor by Merger to
MEMBERS UNITED FEDERAL CREDIT UNION, is a company organized and existing under the laws of the Federal
Government, having its principal office and place of business at 959 East Park Drive, Harrisburg, Dauphin County,
Pennsylvania 17111-2810.
2. The Defendants, DUW A YNE G. YOUNG and APRIL L. YOUNG are adult individuals with an address of
290 Liberty Drive, Shippensburg, Cumberland County, Pennsylvania 17257-8239.
3. On or about November 29, 1999, the Defendants did enter in a Loan Agreement with Plaintiff for the purpose
of purchasing a 2000 Toyota Tacoma vehicle. A true and correct copy of said Loan Agreement is attached hereto, marked
as Exhibit "A" and made a part hereof.
4. The Contract between the Parties was formed and accepted at Plaintiffs place of business, which was in
Shiremanstown, Cumberland County, Pennsylvania.

5. By the terms of the Loan Agreement herein found at Exhibit "A", Plaintiff maintained a security interest is
the 2000 Toyota Tacoma.
6. The Plaintiff further perfected this security interest in said vehicle by having the Pennsylvania Department
of Transportation note Plaintiff s encumbrance on the vehicle's title. A true and correct copy of said title is attached hereto,
marked Exhibit "B" and made a part hereof.
7. Defendants have defaulted under the terms of the Loan Agreement by failing to make monthly payments
when due and owing.
8. The vehicle in question, due to Plaintiffs lack of knowledge as to its condition and mileage, has an unknown
retail value. Currently, the full default balance due is Fifteen Thousand, Forty-Seven Dollars and Eighty-Seven Cents
($15,047.87) per Plaintiff s Statement of Account attached hereto, marked Exhibit "C" and made a part hereof.
9. Due to the default of Defendants, and pursuant to the terms and conditions of the Loan Agreement at said
Exhibit "A", attorney's fees in the total amount of One Thousand Dollars and Zero Cents ($1,000.00) have been added to
said account.
10. The total balance due and owing by Defendants to Plaintiff is the sum of Sixteen Thousand, Forty-Seven
Dollars and Eighty-Seven Cents ($16,047.87).
11. Defendants have failed and refused, despite repeated demands from Plaintiff, to pay the balance due under
the Loan Agreement or to deliver possession of the vehicle in question to the Plaintiff.

WHEREFORE, Plaintiff demands Judgment of possession, together with reasonable attorney's fees, interest and costs.

Kulla, Barkdoll, Ullman and Painter, PC, and answer Plaintiffs Complaint as follows:

owe any additional funds on the truck. By way of further answer, Defendants believe they have
in fact paid more than they owed due to Plaintiffs misapplication of their payments,

NEW MATTER
12. Paragraphs 1 through 11 are restated and incorporated herein by reference.
13, On or about November 29,1999, upon the signing of the loan documents for the
loan subject to this litigation, Defendants informed Plaintiff that they did not wish to purchase
disability insurance,
14, Defendants were nonetheless required by Plaintiffs to purchase disability
insurance as a condition of the loan,
15. During December 2001, Defendants personally submitted a wrilten request to
Plaintiff in Plaintiff s Shiremanstown branch, again asking that the disability insurance be
cancelled,
16, Defendants were set up on an automatic payment schedule,

17, Defendants paid every single monthly truck payment from November 1999 until
January 2002,
18, Defendants periodically paid additional amounts on the principal balance of the
loan.
19, In December 2001, Defendants accepted a holiday promotional offer from the
Plaintiff to "Skip a Pay" in January 2002.
20. In February 2002, Plaintiff failed to restart Defendant's automatic payment
withdrawal and reported a late payment to the credit bureaus,
21. Between February 2002 and January 2004, Defendant April Young altempted
repeatedly to discuss malters regarding the truck loan, the disability insurance and the reporting
of incorrect information to the credit bureaus with Plaintiff, but was advised that she was not a
party to the loan, and therefore, the Plaintiff could not discuss the malter with her,
22, In January 2004, Defendants finally stopped funding the account from which the
truck payments were withdrawn in an effort to force Plaintiff to meet with them regarding
Plaintiffs failure to cancel the disability insurance and regarding the balance on the truck loan,
23, During February 2004, Defendant April Young attempted to contact Plaintiff on
four separate occasions to set up a meeting to go over the account, but was again advised that she
was not a party to the loan, and therefore, the Plaintiff could not discuss the matter with her,
24, During March 2004, Defendant made two additional attempts to set up a meeting
to resolve any issues with the account, again with no success,

AFFIRMATIVE DEFENSE - SATISFACTION
25, Paragraphs 1 through 24 are restated and incorporated herein by reference,
26, Defendants believe and, therefore, aver that they have paid over $50,000,00 to
Plaintiffs since 1999 on a loan of $23,953,52.
27, Plaintiff has failed to properly credit the Defendants' payments,
28, Defendants believe and, therefore, aver that their obligation to the Plaintiff has
been satisfied.
WHEREFORE, the Defendants respectfully request that this Honorable Court enter
judgment in their favor and against the Plaintiff.

files the following Plaintiffs Reply to Defendants' New Matter and Response to Defendants' Affirmative
Defense - Satisfaction, as follows:
PLAINTIFF'S REPLY TO DEFENDANTS' NEW MATTER
12. The allegations contained in Paragraphs 1 through 11 of Plaintiffs Complaint are restated
and incorporated herein by reference.
13. Admitted in part and denied in part. It is admitted that on November 29, 1999, the
Defendants did sign loan documents with Members United Federal Credit Union. It is denied that
Defendants informed Plaintiff they did not wish to purchase disability insurance but, rather, right on their
Application, they signed for and agreed to accept credit disability and credit life insurance.
14. Denied. Purchasing credit disability and credit life insurance is not required by Plaintiff as
a condition of a loan. It is further noted that Defendants also received loans on February 20, 1996; January
20,2000; and March 7, 2000; and each and every time they purchased credit disability insurance for each
loan. Furthermore, On January 31, 2001, the Defendants received $886.10 in credit disability benefits paid
to their loan accounts.
15. Denied. Plaintiffhas in its care, custody and control no evidence that any such document was
submitted to the Credit Union.
16. Admitted in part and denied in part. It is admitted that Defendant, Duwayne Young, was set
up for automatic payments until he reduced payroll to $50.00 per week on December 1,2003, and requested
the $50.00 to be deposited in Share Savings,

20. Admitted with explanation. Automatic payment was inadvertently missed and not restarted
by the Credit Union. The members would have received late notices letting them know that their payments

were not being posted as scheduled. As is the Credit Union's practice, when the members notified the Credit
Union that their payroll was not restarted, all late fees which were incurred were waived and notification sent
to the Credit Bureau to correct the Defendants' credit reports.
21. Denied. Plaintiff has no record of Defendant, April Young, attempting to "repeatedly"
discuss matters regarding the truck loan, the disability insurance and the reporting of incorrect information
to the Credit Bureau with Plaintiff.
22. Denied. On April 21, 2003, Defendant, Duwayne Young, signed a subsequent action
cancelling the disability insurance on his loan. However, Mr. Young did elect to continue to carry credit life
msurance.
23. Denied. Plaintiff has no record that during the month of February, 2004, Defendant, April
Young, attempted to contact Plaintiff on four (4) separate occasions to set up a meeting to review the
account but was again advised that she was not a party to the loan and Plaintiff could not discuss the matter
with her.
24. Denied. Plaintiff denies that during the month of March, 2004, the Defendants made two (2)
attempts to set up a meeting to resolve issues that were outstanding.

WHEREFORE, Plaintiff respectfully request that Judgment be entered in Plaintitl' s favor and against
Defendants for possession of the vehicle in question as prayed for in Plaintiffs Complaint.
RESPONSE TO DEFENDANTS' AFFIRMATIVE DEFENSE - SATISFACTION
25. The allegations contained in Paragraphs 1 through 11 of Plaintiff s Complaint and Paragraphs
12 through 24 of Plaintiffs Reply to Defendants' New Matter are restated and incorporated fully and at
length herein.
26. Denied. Defendants have paid to Pennsylvania Central Federal Credit Union, the successor
to Members United Federal Credit Union, the total sum of Seventeen Thousand, Six Hundred Twenty-Five
Dollars and Seven Cents ($17,625.07). Plaintiff demands that Defendants provide proof of the Fifty
Thousand ($50,000.00) Dollars in payments at trial.
27. Denied. Plaintiffs response to Paragraph 26, supra, is incorporated fully and at length
herein, and proof thereof is demanded at trial.
28. Denied. Plaintiffs response to Paragraph 26, supra, is incorporated fully and at length
herein, and proof thereof is demanded at trial. Furthermore, Plaintiff denies the allegation since, as pled in
Plaintiffs Complaint, the Defendants owe to Plaintiff the sum of Sixteen Thousand, Eight Hundred Thirty-

2. The undersigned alleges that Duwayne G. Young and April L. Young have not
sufficiently cooperated with the undersigned to allow the undersigned to diligently represent their
interests, by inter alia the fact that the Youngs have repeatedly 1) failed to respond to inquiries of
counsel, 2) failed to comply with counsel's advice, and 3) failed to pay counsel fees,
