The above captioned Decedent died intestate on August 15, 2012, and Letters of Administration on the Estate of the Decedent were duly issued by the Register of Wills to your Petitioner on October 18, 2012. 5. The deductions on said return exceed the assets,the Estate is, therefore, insolvent, and no tax is due. 12. It is proposed that the following distribution of the Decedent's Estate be made to the following creditors,heirs, or next of kin. A. Costs of administration entitled to first priority payment under 20 Pa. C.S.A. Section 3392: Claimant Basis of Claim Amount Dick, Stein, Schemel, Wine & Frey, LLP attorney's fees $1,800.00 B. Since the Decedent was unmarried at the time of his death, and did not reside with either of his two (2) children, or his parents, at the time of his death,there is no one entitled to claim the family exemption, which would be entitled to a second priority payment under 20 Pa. C.S.A. Section 3392. C. The cost of Decedent's funeral and burial,are entitled to a third priority payment under 20 Pa. C.S.A. Section 3392, however, only a portion of said costs can be repaid due to a lack of funds available in Decedent's estate. It is therefore proposed that the balance of the funds in the estate $1,298.76, be paid to John M. Norris, as partial reimbursement for the costs of Decedent's funeral and burial. 13. Since the assets of the Estate are insufficient to pay the Decedent's funeral and burial expenses in full, which are entitled to a third priority payment,the remaining creditors,which would be entitled to a sixth priority payment under 20 Pa. C.S.A. Section 3392,will not receive any payment from the Estate nor will there be any funds available for distribution to the Decedent's intestate heirs from the Estate. , ; , , . . � . . . � 14. Notice of Intent to file this Amended Petition has been given to all interested heirs and unpaid creditors of the Estate.
