Hobaugh & Sons, Inc., is a Pennsylvania corporation with a principal place of business at 98 Herman Avenue, Lemoyne, Pennsylvania 17043. 2, The defendant, Henderson Construction Services, Inc., is a Pennsylvania corporation with a principal place of business at 1200 Greensprings Drive, York, Pennsylvania 17402. 3. The plaintiff contracted with the defendant whereby plaintiff agreed to provide electrical contract work for the project referred to as the Foot Locker Restrooms Project on about May 24, 2012. A copy of the purchase order executed by the parties showing the contracted for price of$45,708.00 is attached hereto as Exhibit "A". 4. Shortly after the commencement of the work, the defendant altered the specifications of the project by upgrading the light fixtures. The defendant approved the additional costs for the upgraded light fixtures. The upgrade costs and approval thereof is attached hereto as Exhibit"B". 5. - The plaintiff completed its contract for work including the-upgraded light fixtures in a timely manner in accordance with the contract. 6. There remains due and owing on account of the project the 10%retainer totaling $4,570.80 and the upgraded light fixture costs totaling $5,386,00. 7. Despite repeated requests for the same, defendant has failed to pay the retainer nor the additional light fixture costs to the plaintiff. The total amount due is $9,956.81, together with costs of suit including the costs incurred before the district justice totaling $153.50 for total amount due of$10,110.31.
