Kindly withdraw with prejudice the divorce action Curran v. Curran at Civil
Action No. 04-6538 I inadvertently filed this action on behlllf of my client Stephen
Curran not realizing that his wife Pamela had previously filed a divorce action at No. 04-
4333. The Court entered a final divorce under the 04-4333 action on the 21" day ofJune,
2005. The above caption action is therefore mute and should be dismissed with
prejudice. I am attaching a letter from opposing counsel indicating his agreement that
this action be dismissed.

COMPLAINT IN DIVORCE UNDER SECTION 330UC)
OF THE DIVORCE CODE
1. Plaintiff is Stephen C. Curran, an adult individual who currently resides at 1026
Pina Circle, Mechanicsburg, Cumberland County, Pennsylvania.
2. Defendant is Pamela Curran, an adult individual who currently resides at 85
Oneida Road, Camp Hill, Cumberland County, Pennsylvania.
3. Plaintiff and Defendant have been bona fide residents in the Commonwealth for at
least six (6) months immediately previous to the filing of this Complaint.
4. The Plaintiff and Defendant were married on July 4, 2003 in Gaitlenburg,
Tennessee.
5. There have been no prior actions of divorce or for annulment between the parties.
6. Neither Plaintiff nor Defendant is in the military or naval services of the United
States or its allies within the provisions of the Solders' & Sailors' Civil Relief Act of the
Congress of 1940 and its amendments.
7. Plaintiff avers that there are no children of this marriage.
8. Plaintiff seeks a divorce on the following grounds:
a. Defendant has offered such indignities to the innocent and injured spouse as to
render his condition in tolerable and life burdensome; or
b. The marriage is irretrievably broken.
9. Plaintiff has been advised that counseling is available and that Defendant may have
the right to request that the court require the parties to participate in counseling. Plaintiff
declines counseling.
10. After ninety (90) days have elapsed from the date of the filing of this Complaint,
Plaintiff intends to file an Affidavit consenting to a divorce. Plaintiff believes that Defendant
may also file such an affidavit.
11. In the alternative, Plaintiff will pursue a fault divorce under 3301 (a) (6) of the
Divorce Code.
WHEREFORE, Plaintiff respectfully requests this Court to enter a decree of divorce
pursuant to Section 3301 (a), (b), or 3301 (c) or 3301 (d) ofthe Divorce Code.
COUNT I
EOUITABLE DISTRIBUTION
12. Paragraphs one (1) through eleven (11) of this Complaint are incorporated herein by
reference.
13. Plaintiff and Defendant have acquired property, both real and personal, during their
marnage.
14. The parties have acquired marital debt during their marriage.
15. Plaintiff and Defendant may be unable to resolve amicably the property issues in this
matter.
WHEREFORE, Plaintiff respectfully requests this Honorable Court to equitably divide
all marital property and debt.
