SOPHIE'S AT THE MARKET, LLC, a Pennsylvania limited liability company, having an office at
1233 North Third Street, Harrisburg, Dauphin County Pennsylvania, hereinafter called "Tenant", has executed,
or is about to execute contemporaneously herewith, a contract with CAPITAL AREA CONSTRUCTION, INC, a
Pennsylvania corporation, with its registered office at 35 Fort Street, Lemoyne, Cumberland County,
Pennsylvania, hereinafter called "Contractor", for modifications to the interior and facade of the premises which
Tenant occupies as tenant pursuant to a Commercial Lease, said leased premises being a portion containing a
rentable area of 2,736 square feet within a one story retail/commercial structure known as the S_h.0pPe__s of
Ha~ (hereinafter called the "Building"), constructed upon a tract of real estate (the "Land") situate in
Hampden Township, Cumberland County, Pennsylvania, said leased premises being munidpally known and
numbered as 3700 Market Street, Camp Hill (Hampden Township) Pennsylvania, and being shown, delineated
with cross-hatching, on Exhibit "A", attached hereto and made part hereof.
NOW, November. !..~, 2004, before any authority has been given by the said Tenant to the said
Contractor to commence work on the said building modifications or to purchase materials for the same, in
consideration of the making of the said contract with Tenant and the further consideration of One Dollar
($1.00), to Contractor paid by Tenant, it is agreed that no lien shall be filed against Tenant's leasehold interest
in the above described leased premises, or against the Building or the Land, by the Contractor, or any sub-
contractor, nor by any of the material men or workmen or any other person for any labor, or materials
purchased, or extra labor or materials purchased for the construction of said building modifications, the dght to
file such liens being expressly waived.
