Defendant(s) CIVIL ACTION - LAW COMPLAINT The Plaintiff, YALE ELECTRIC SUPPLY CO., by its attorneys, KODAK LAW OFFICES, P.C., brings this action of Assumpsit against the Defendant(s) to recover the sum of THIRTY FIVE THOUSAND SIX HUNDRED THIRTY -FIVE DOLLARS AND THIRTY -NINE CENTS ($35,635.39), along with interest thereon at the rate of 1 '/2% per month from November 19, 2011, together with any and all court costs incurred by Plaintiff, upon a cause of action of which the following is a statement: 1. The Defendant, R. B. HOBAUGH & SON, INC., is a corporation having its principal office and place of business at 98 Herman Avenue, Lemoyne, Cumberland County, PA 17043. , 3. Defendant, R. B. HOBAUGH & SON, INC., is a corporation organized and existing under the laws of the Commonwealth of Pennsylvania, as more fully set forth on the Pennsylvania Department of State Corporation Bureau print out attached hereto, marked Exhibit "A" and made a part hereof. 4. On the dates, in the amounts, and for the prices set forth in a true and correct copy of the Plaintiff's Statement of Account hereto attached, marked Exhibit "B" and F: \USER \COMPLAINTS \Y \YALE ELEC v RB Hobaugh 38990 rzs.wpd 2 made a part hereof, Plaintiff, at the special instance request of the Defendant(s), sold and delivered goods, wares and merchandise and /or performed labor and provided services of the kind and description set forth on said Exhibit to the total amount of Thirty Five Thousand Six Hundred Thirty -Five Dollars and Thirty -Nine Cents ($35,635.39). 5. The prices charged for said goods, wares and merchandise and /or labor and services provided were just and reasonable, were the legal and market prices therefor and were the prices which the Defendant(s) promised and agreed to pay to Plaintiff. 6. Plaintiffs Invoices are not attached to this pleading due to the voluminous nature of same and have previously been provided to Defendant(s). 7. Plaintiff frequently demanded payment from Defendant of said amount due and owing as aforesaid, but Defendant refused and neglected and still refuses and neglects to pay said amount or any part thereof. WHEREFORE, Plaintiff brings this suit to recover from Defendant the sum of THIRTY FIVE THOUSAND SIX HUNDRED THIRTY -FIVE DOLLARS AND THIRTY -NINE CENTS ($35,635.39), together with interest as set forth herein, together with any and all court costs incurred by Plaintiff.
