THIS AGREE~/~f made this Ii day of ~0¥~-'~.~_ 2004, by
and between Larry V. Neidlinger, of, Carlisle, PA 17013,
hereinafter referred to as Contractor,
Larry V. Neidlinger and Mary J. Neidlinger, husband and wife,
hereinafter referred to as Owners, whereby the contractor undertook
and agreed to erected and construct a dwelling on the certain lot
of ground situate in West Pennsboro Township, more fully described
in Exhibit "A" which is attached hereto and made a part hereof and
known as Lot No. 3 Greason Road, Carlisle, PA.
NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the said
Contractor, for an in consideration of the sum of ($1.00) Dollar to
Contractor in hand paid by Owner, the receipt whereof is hereby
acknowledged, and the further consideration mentioned in the
agreement aforesaid, for itself, himself or themselves and its, his
or their subcontractors, and all parties acting through or under
them, covenant and agree that no mechanic's liens or claims shall
be filed or maintained by them or any of them against the said
buildings and the lot of ground appurtenant thereto for or on
account of any work done or materials furnished by them or any of
them under said contract or otherwise, for, towards, in, or about
the erection and construction of the said buildings on the lot
above described, and the said Contractor, for itself, himself or
themselves, its, his or their subcontractors and others under them,
hereby expressly waive and relinquish the right to have, file, and
maintain any mechanic's liens or claims against the said buildings
or any of them, and agree that this instrument, waiving the right
of lien, shall be an independent covenant.

ALL THAT CERTAIN tract of land situate in West Pennsboro Township,
Cumberland County, Pennsylvania, being Lot No. 3, as shown on Subdivision Plan
for Larry V. and Mary Jo Neidlinger dated March 3, 2004, last revised July 24,
2004, and recorded in Cumberland County Plan Book 89, Page 127, being bounded
and described as follows:
BEGINNING at a point in the centerline of Township Road T-451 Greason Road at
the dividing line between Lot 1 and Lot 3 of the above referenced plan; thence along
said dividing line, North 53 degrees 00 minutes 00 seconds East 365.00 feet to an
iron pin set; thence along same, North 71 degrees 12 minutes 38 seconds East 49.89
feet to an iron pin; thence South 32 degrees 20 minutes 07 seconds East 265.11 feet
to an iron pin set; thence along the dividing line between Lot 1 and Lot 3 of the
above referenced plan, South 57 degrees 39 minutes 53 seconds West 342.66 feet to
an iron pin set; thence by a curve to the right having a radius of 40.00 feet, an arc
length of 61.15 feet to a concrete monument; thence South 55 degrees 15 minutes 00
seconds West 25.00 feet to a point; thence by the centerline of Greason Road T-451,
North 34 degrees 45 minutes 00 seconds West 62.67 feet to a nail at intersection of
Township Roads T-443 and T-451; thence by the same, North 33 degrees 08 minutes
00 seconds West 147.25 feet to a point, the place of BEGINNING.
