ORDER OF COURT
AND NOW, this ay of August, 2013, following a scheduling conference
with counsel, which was held because objections were filed to First and Partial Account
of the Trust Under Revocable Agreement with Lottie Ivy Dixon, we ORDER AND
DIRECT as follows:
1. M&T Bank is afforded 30 days to file a motion to strike the aforesaid
objections.
2. Following receipt of said motion, the court will determine if it is appropriate to
appoint an auditor, schedule a hearing and/or decide the matter on the basis
of briefs and argument.
3. Because counsel for George F. Dixon, III and Richard E. Dixon, the
Objectors, has indicated that a conflict will necessitate the retaining of
replacement counsel, a possibility first raised in the status conference on
June 17, 2013, the Objectors are advised that the court intends to proceed
expeditiously, with or without counsel.
